Hi all, I have just started working on the letter to Lufthansa to get compensation about the flight last year which made us arrive at the destination 7 hours late.
The thing that I am not sure about is:
We arrived to Frankfurt with Lufthansa just in time to get a connecting onward Lufthansa flight to Sofia, however we were refused boarding, their excuse was: the plane has already left!
Even though it was still only 09.30 hrs when we were at the check in desk, and the departure time of next flight was 09.50. Obviously the plane couldn't have left nearly half hour early.
So we were re-routed to Sofia via Munich, arriving 7 hours later than planned.
Is this considered a "delayed" flight, or a "cancelled" one?

Sorry if I may sound repetitive, just to double check on another situation:
We arrived to Frankfurt, boarded the plane,plane moved off almost on time, then were about to take off, however due to some backlog we spent some minutes on the plane, waiting for the permission to take off. We literally started taxiing away for take off, when the plane was refused take off due to the time being 1 minute after 11pm, when the "no flights" curfew starts in Frankfurt airport. So we spent part of the night at nearby hotel, supplied by Lufthansa. Then we departed Frankfurt to our destination at 9am, on a different flight.
Does this situation classify as "cancellation", or still a "delay" ?0 -
Hi I'm trying to claim compensation for a flight from London to Tokyo in 2007 - there was a fault with the plane and we were 24 hours late.
I wrote to Alitalia using MSE template letter and after chasing got this reply...
"We wish to explain that, effective on the 13th January 2009, a different compay known as Alitalia - Compagina Aerea Italiana S.p.A., was formed, which is completely separate from the former Alitalia Linee Aeree Italiane S.p.A. which ceased trading on the 12th January 2009. This means that we are not empowered to deal with any issue arising from your travelling with Alitalia Linee Aeree Italiane S.p.A. in March 2007"
I've searched this forum but can't find anyone else whose had this problem, sorry if I've missed it. Who should I send my claim to?
Any help or advice for next step would be much appreciated!

First time on forum not exactly sure what this is about
I have heard about these claims on flights and not just delayed, in 2007 I was on a flight with my friend to Thailand, we had to make an emergency landing in Calcutta, a local paper in merseyside printed a story including a statement from the airline but I'm not sure I can share the link on here.... They claim we landed as we had ran out of fuel due to avoiding flying into some kind of forbidden war zone space in the air... My memory is not too good but I think we was grounded on the plane on the runway for maybe 7 hrs .. we did not have permission to get off the plane, as there was no fuel we had no air con, it was very hot we had to open the doors and people where sitting on the stairs too cool down but men in jeeps were guarding the plane to make sure we didn't step onto Tarmac... It was said we was in negotiations about tax and fuel and was there for so long as the airport would not accept the airlines method of payments , it was a distressing time for all on board ... Would there be a case here for compensation only I don't remember even who I booked through but have the date and airline from the local news paper... Sorry for the waffle any advice would be appreciated ..0 -
I recently submitted a compensation claim to Air France using the MSE template and attaching the original booking e-mails. The response below disagrees with the statement the you can claim back to 2005. Any thoughts on what I should do next?

Air travel is governed by the international body of law known as the Montreal Convention of 1999. Article 35 of this regulation sets a time limit of two years from the date of the planned or actual arrival of a flight to claim for damages.
We have carefully considered your request and taken into account all relevant details for your delayed flight. Consequently, we confirm that you have made this further claim outside this two year limit and so I must respectively decline your request on this occasion.
Thank you for allowing us this opportunity to explain our position in this matter. I do hope that we will have an early opportunity to service your travel needs again in the future.0 -

I was just wondering if any one can advise me about my claim with Iberia...
In 2009 I was returning from Bogota with a connection in Madrid. In Madrid we missed our connection and the 20 or so of us affected were told that we would be put on the next available flight; however for some people the next available flight was later that day and for me and a few others, not till tomorrow (they didn't explain why some people got priority).
As a freelancer I needed to get back for work the next day (I only get paid if I show up!) so they put me and a few others on standby. We therefore had to queue at the Iberia desk to get on the list for standby for the next flight, then wait at the gate and watch others board before finding out the flight was full, then race and fight with each other and run back the length of the terminal to be first in the queue at the desk for the standby list for the next flight. It was stressful and humiliating and incredibly upsetting and there were tears (I'm not normally prone to over emotion!). But by this stage I had been travelling for about 15 hours already, sleepless from a night flight, still wearing the same clothes from the previous day and night, with no bags etc... and all I was given a dry cheese sandwich and a bottle of water...
Eventually I was put up in a hotel in the middle of nowhere and given flights for the next day. Still with no luggage, still in the same clothes. I made it home the next day, 41 hours after leaving Bogota... my suitcase didn't make it back until 2 days later.
I wrote them several complaint letters at the time and took the case to the Air Transport Users Council but in 2009 they were not obliged to pay me compensation. I still have all the documentation.
It's clear from reading the forums and articles that this time round there should be no problem claiming 600 euros for the delay in getting home. My question is this...
Should I just claim for the delay and leave it at that or mention the other stuff too (loss of earnings, delayed baggage, pain and suffering)? I kind of feel that putting those things in will complicate the issue and delay my claim and I should just keep it simple. But part of me feels I deserve more for all the trauma that Iberia put me through...
Thoughts would be much appreciated.

Hey there, not sure if this has arisen - 260 pages was a bit too much to trawl through! I've made a complaint already through the BA website, but wondered if anyone had any thoughts on my particular case.
My wife and I were due to fly back from our honeymoon back in April 2010, from Mauritius to Heathrow, right in time for the ash cloud to descend. Obviously there was carnage with the flights, and ordinarily I think that we wouldn't have a case as it was out of the airlines hands. However...
Our flight number actually flew from Mauritius airport (I think it flew on time, as well), but we were bumped from the flight in favour of people whose previous flights were cancelled. Because of this, I think we might have a case as it was the airline's fault that we didn't get on our flight, and not the "act of god".
As a result, we didn't fly back for another 12 days.
It seems fairly cut and dried to me, but obviously the pound signs are flashing so I might be overly optimistic!
