Hi, i flew to Malaga from Manchester airport back in September 2006 and had a massive delay. I was supposed to fly at 8am and didnt leave until after 4pm. The delay caused me loads of problems because i was supposed to be picked up by my brother but by time i arrived he couldnt get me so had to get a taxi which was difficult as the driver spoke no english. I was travelling alone and it was awful. I remember complaining at the time to Thomson Fly as they were then but i just got fobbed off. Can i try and get compensation now? I unfortunately dont have any documents the only thing ive got is my boarding pass which shows my name, flight number, departure time and date as it was over 6 years ago. Any advice appreciated.
Also can i claim from Virgin Atlantic, i was booked on a flight to Las Vegas on 9th February 2011 but they cancelled this flight and changed me to the flight on the 10th February. Id already booked a flight down to Gatwick from Manchester on the 9th and it was going to cost me more than the ticket to change the flight to the 10th so had no choice but to travel down on the 9th and stay overnight at Gatwick. Again i have no proof of the hotel but ive got the boarding pass for the flight to gatwick on the 9th and the flight to Las Vegas on the 10th. Can i claim compensation for this because my holiday was cut short from 7 nights to 6 nights?
    Thanks in advance.

    1) As this is over 6 years ago, you will be unable to take this through the court system. For the price of a stamp you could contact the airline and make a claim but if they decline there is nothing you can do about taking it any further

    2) How far in advance of your flight was the flight cancelled? If over 14 days you should have been given the choice of refund or rerouting (no compensation)
If less than 14 days then you can possibly claim for the compensation.
note: the compensation is a fixed fee based on the distance and delay. Your contract will have commenced from LGW so the fact that you booked a separate flight and hotel are consequential losses. Did you look to your travel insurance at the time?

    Thanks

you could try submitting a claim to BA however there is no evidence of them paying out on bmi baby claims

    Hi
I was delayed in Delhi on 05/04/2010 for over 48hrs due to a mechanical problem with Air France flight which was flying me back to UK via Charles de Gaulle can I claim any compensation ??
We actually checked in and boarded the flight which was due to leave at 00.20am on 05/4/10 and we were left to sit on the plane until 05.00am before we were told that the flight was not leaving and we were taken off the plane and back into the airport . Then about 6.15am they reboarded us back on the plane and we waited again but still no take off.
Eventually at about 7am they told us the flight will not be leaving and that we would be taken to a hotel so we aere all put on coaches and arrived at a nearby hotel at 7.30am exhausted and sleepless.
I do not have any ticket details but do have leaflets given to us by air france regarding the update on the delays ,also my passport shows details of the dates i actually flew out and the check in stamp for 05/04/10 being cancelled .
The mechanical fault could not be repaired ,something to do with fuel pressure and as far as i am aware they had to provide a additional flight which apparently came in from france and we eventually flew out on 07/04/2010.
Me & 300 other passengers were put up in a hotel for the time of the delay but we were not offered any alternative flights by the airline to get us back home earlier .
So do I have a right to claim and is it covered by the Regs ??

This is the reply i had from Air France so what next

    Dear Mrs

Thank you for your further communication in reply to my emailed response to your claim,on 30 January.

I am sorry that you have needed to contact us again and also to learn that you have not received the commercial gesture we offered you in our emailed communication of 10 April 2010, further to the incident to your flight AF225 on 05 April 2012.

I copy this message below together with confirmation of the360 GBP electronic credit note sent as part of the same 10 April 2010 email.

I carefully reconsidered your request but must respectfully decline your request once more as having been lodged too late . Our two years claim limit is set in the terms of the Montreal Convention and in our General Conditions of Carriage.

I can assure you that we are well aware of our commitment to provide excellent customer service at all times and I hope that you will understand and accept our decision.

    Yours sincerely,

I wrote to AESA (Spanish Regulator) about an 8 hour delay out of Palma last June. Quite slow, they wrote to Thomas Cook requesting a report into the incident. After 10 weeks received another letter from them saying that TC had not bothered to reply to them after two months and therefore the AESA considers that the company has not proved that the long delay was caused by extraordinary circumstances , and accordingly should pay me and my party 400 Euros each.

That was on 19th November, and Thomas Cook still wont pay up, have therefore taken them to court. I do however feel that refusing to respond to the national enforcement body is as good as admitting fault, only hope the judge does.

Hi There, I presume you have a copy of the AESA report, you must issue Legal proceddings via the MCOL in the UK. I also have an AESA report declining extrordinary circumstances, stating we should be paid 1200 Euros, and compensation for under the Montreal covention. My case it is Iberia, who have refused everything, changed their defence statement three times, I am awaiting a County Court date. Do not let them get away with it. Best of luck.

    Hi, thanks for responding.
If I complain to Thomson and they reject it can i refer it to CAA or is that as far as I can go? I don't have any tickets apart from my boarding pass.
The Virgin flight to Las Vegas was booked through Travel Republic as a flight & hotel package, I can't remember when they informed me that the flight had been cancelled and we had been put on the flight the next day making my holiday 6 nights instead of 7. As far as I'm aware I was never offered the option to cancel and get a refund and as this trip was for my 40th birthday we just chose to go on the 10th as they was little else we could do I thought. Didn't check with my insurance because I thought I only had cover for things like delays & baggage or medical problems. Worth an attempt to claim? I only have boarding pass and not any documentation?
    Thanks.

I think the first one will be a lost cause, the airline will say no as they know there is nothing you can do about it as we have passed the 6 year point so you cannot take them to court

The Vegas one will only be due for compensation if you were advised of the delay less than 14 days before the affected flight, so you need to be able prove that this was the case. If they told you 15 days before departure and you accepted the alternate flights there is nothing due.

Quick question, apologies if it's been asked previously but it's a long thread.
Why is the amount for 3500+km for 3 hours less than the amount for less than 3500km for 3 hours...?

Also, if we had a flight with BA booked through Thomas Cook, is the claim and contact with Thomas Cook or BA...? Looked at the BA claim web page but it requires a booking reference - we only have a Thomas Cook itinery number.

    Thanks all...
  • i am just starting a claim for a flight that was delayed for 24 hours in january 2011
i dont have any information about the flight as i have thrown all the paperwork away
does anybody know how to find out the flight number and flight details

cirelav - do you have airline, flight numbers, dates etc?
Personally i don't think you need boarding cards if you can prove you were on flight.

Yes I do have an itinerary from the travel agents with all the flight details recorded and the booking reference. I have completed a form to TUI and explained that I do not have tickets and boarding cards but given them the itinerary and told them that they should have details on their records.
