  • Just as a follow up to that, I had no boarding passes, no booking number, no confirmation email and the flights were in June & July 2010 so they were over 2 years ago.

    Waffle basically , to quote their letter "more specifically the delay was caused by an unexpected flight safety shortcoming"

    Has anyone else got this /seen this? Do they mean the boarding passes? Whatever it means it does appear that they are saying they won't deal with us unless its enclosed. Also ,it says on the form any missing info or evidence will just result in the form being returned to us.
    I have the original confirmation emails with booking numbers that I can enclose . Surely this should be enough to pinpoint us and the flight in question...? They will do anything possible to delay and block us ,I know.

    My flight Jet2 from alicante to manchester was 7 hours late and jet2 are trying to wriggle out of compensation

    can i take them to the small claims court in the UK , or would I have to use a Spanish court ?

    I do not think the boarding passes will be required in a court room ;-) And yes they will do anything to wriggle out of paying. I would just write saying you no longer have them

    Hi all, I was due to fly on From Reus (Barcelona) (REU) to Liverpool (LPL) Thu, 23Jun11 Flight FR9825 Depart REU at 18:45 and arrive LPL at 20:10. This flight did not fly, it sat on the ground while we saw technicians working on it until they gave up, the reason for the flight not flying was given at the time as technical issues. We waited a total of about 6 hours for another Ryanair flight to arrive from somewhere else, once the passengers got off, we boarded this plane and flew home around 6 hours late than scheduled. Ryanair have denied my claim for flight delay stating it was "safety/technical issues" which are extraordinary circumstances. My question is, should I claim for denied boarding or flight delay?

    The delay seems to have been just over 4 hours leaving LHR. You would appear to have a claim but the difficulty you have is bringing a legal action against a Nigerian-based airline which is unlikely to have an office in the UK against which a claim could be started.

    Unless you have access to legal expenses cover under your household contents insurance which could be used to conduct a claim on your behalf, you might be better off putting this one down to experience.

    Hi Their,
    Assuming jet2 has a uk registered office, you can issue legal proceedings via the UK small claims, at Money claims on line (CCMCC) at Northampton County Court. You will have to submit to Jet2 a final notice before action, first allowing them a period decided by you, to settle your claim fully. If they do not, you will require to fill out a N1 county court claim form,submit it to Northampton (CCMCC) County Court Money Claims Centre, PO box 527, Salford M5 0BY. You will require to attach payment for the initial court fee as required. Fees are as per leaflet EX50:- there are two tables, Court Issued, (actually doing it via local county court), or Money claims online.(internet based claim).
    Court issued:- up to £300 fee £35.
    From £300.01 to £500 fee £50
    From £500.01 to £1,000 fee £70
    From £1,000.01 to £1,500 fee £80
    From £1,500.01 to £3,000 fee £95

    Internet MCOL:- upto £300 fee £25
    From £300.01 to £500 fee £35
    From £500.01 to £1,000 fee £60
    From £1,000.01 to £1,500 fee £70
    From 31,500.01 to £3,000 fee £80.
    Payable to HM Courts & Tribunals service.

    You at a latter stage if they defend the case, will have to pay a hearing fee for small claims, based on the same tables with five parameters as above with fees respectively as being £25, £55, £80, £110, £ 165.

    If you win your case, the defendent will have to pay your Court fees, and you can claim interest at a daily rate of 8% per annum, from the date of your flight delay or claim, which can be a tidy amount. Now although the payments are based in Euros, for your claim against the airline in variable fixed sums, you should use the Foreign Exchange rates at the time of the incident, these are found on the internet as FX tables, where you insert the date of the delay etc. This can be a different sum payable than the current exchange value.

    Just as a guide for info only:-

    [In my own ongoing case going back to 12/2010, it amounts to £1004.88, for 2 x 600 euros, against the current exchange rate of 0.817 @ 25/12/2012, which equates to £980.36 FX rate, So in essence my claim is £24.52 higher than todays exchange rate].

    On 23 of Dec I had a flight with Air caraibes from Fort de France to Paris Orly which landed with 3.5 hours delay. Initially the flight was supposed to depart at 18:00. We were first announced that it was delayed to 19:15, then to 19:50 (I mention that the airplane arrived at gate - from another flight -approx 17:45). After boarding we sat in the airplane for about half an hour and were announced that the delay is due unloading a couple of passengers' baggage, after this we were announced that a fuel pomp at one of the engines had to be replaced and we waited for another 1.5 hours.
