    As far as I'm aware a "knock-on effect" doesn't constitute extraordinary circumstances. As far as I'm aware the law is still a bit ambiguous regarding what can and cannot be labelled "extraordinary circumstances".

    As far as getting compensation, e-mail the CAA, and make a point of replying as quickly as possible to every e-mail they send.

    If yes then it would be classed as 'denied boarding' so are entitled to compensation. Different to the recent ruling regarding delays

    Yes the flight left about half 5 with all but 70 passengers on it
    I have sent an email/complaint thing through their website on the 18th just waiting to here back now

    Thomson refused my claim (Flight delayed due to the pilot being ill) claiming it was an exceptional circumstance. I have now written to the CAA.

    Aircrew sickness or absence should not be ruled as "extraordinary circumstances" as these instances happen in all walks of life and it is very much within the control of the airline to manage this type of event.

    Yup that is what I thought, shall wait and see what the CAA think.

    Thanks. Well I got email off them an hour ago stating they can't find my booking! Bizarre but I have gave them additional info now so I don't see why they won't find it
    But fingers crossed we get some good news really soon

    What would be next move if I cannot provide reference number? When dealing with banks etc I have sent Subject Access Request, should I now do this with Thomson?
  • I currently have a claim through from Thomas cook regarding flights for me and my girlfriend from manchester to Cyprus and back again. Both were delayed by over 4 hours, the first due to a chartered plane running late and then the boarding process being fluffed up resulting in a missed takeoff slot. The second due to having a plane out due to maintenance.

    I have chased it again today and apparently there is a letter in the post. Interestingly, it contains this paragraph:

    "Although delays do occur on occasion, they can arise for a number of different reasons, and having carried out a full investigation I would assure you that we took all reasonable steps possible to minimise the waiting time for our customers. In line with our obligations under Regulation 261, I would ask you to accept the enclosed voucher to the value of £1260.00 I trust this will allow us the opportunity to prove to you that your experience is not typical of our usual performance."

    Now I haven't seen this voucher yet so will reserve judgement and i realise that it isnt cash however I trust that this will serve as some hope to some of you out there. The key thing being acceptance of responsibility for having planes out for maintenance.

    Check your emails just in case you have the booking number. Also check on there website
    And don't worry centipede, I do plan on taking this all the way. If I was delayed for a few hours then maybe not. But to be left in the airport overnight with a packet of crisps as food, they have failed altogether under the regulation
