Compensation for delayed flights Discussion Area

Hello all.
Hope someone can help/advise me. We flew Virgin Atlantic VS016 on 7/11/12 original time 19.50pm from MCO to LGW. Flight delayed and left at 02.15am so 8/11/12. We were given $15 each for meals(2ad2ch). As delay over 5 hours I completed eu compensation forms on their website and submitted. Their response as follows:
Dear Mrs xxxx
We regret to advise that we have declined your claim on the grounds that the cause of the delay was caused by extraordinary circumstances which were beyond the control of VA and which could not have been avoided even if all reasonable measures had been taken.
In your particular case the flight was delayed as during landing of the inbound aircraft, warning messages came to light advising of vibrations in engine no 2. Our engineers investigated the problem, through various troubleshooting.
After using specialist equipment to look deep inside the engine, accidental damage was found to the engine blades resulting in engine no 2 needing complete replacement. In an effort to avoid cancelling or causing a significant delay to the service another aircraft was taken utilised to operate the flight out of Orlando which in return operated your flight back to the UK.
This was a technical problem stemming from events which by their nature or origin are not inherent in the normal exercise of our flying activity and are beyond our actual control.
We offer our sincere apologies for the inconvenience caused by the disruption to your flight and any disappointment this decision brings.
Yours sincerely
Xxxx

Hi I have had a quick read through of the thread as I am thinking of putting in a claim to monarch as I was delayed for just over three hours coming home from cyprus in August tho I am not sure of the reason to the delay.
I was also delayed home from Orlando in December 2005 by 24 hours plus we were put up in a nice hotel and fed am I still able to claim I know the airline was Travel city direct but that is all the information I have for this flight. Do I need paper evidence or will the date of flight be enough?
Thanks in advance.New to comping 11/2/2013

I submitted a claim to Monarch over 6 weeks ago. I have received an acknowledgement but no reference number for my claim. They have ignored my request for a reference number. I already have a letter from Monarch in 2011 stating the 5 hour delay was due to aircraft technical problems so I cannot see why the delay in offering the required compensation. Where do I go from here. How can they trace my claim without an allocated claim reference number.0

After reading the last few pages, I do not yet see a scenario that I experienced, thus I am after some advice.
I was in Orlando, FL visiting my family for 3 weeks when my return flight was cancelled.
Details are
Outbound flight from NCL - AMS - ATL - TPA which was on time.
Return flight was TPA - ATL - AMS - NCL of which, the second leg ATL - AMS was cancelled with a few hours notice. I got a call from Opodo in Manchester in the morning of the flight saying the flight was cancelled due to a 'technical issue' with the plane before leaving AMS for ATL. I managed to rebook the following day to get home and never thought about claiming once back.
I did claim after a couple of weeks with KLM for the delay. I was offered a TCV of £75 which I did accept as I did not know my rights etc. I have now since submitted a new claim to KLM based on reading this thread.
Am I likely to get anywhere as I accepted the TCV? Does it matter that I did not use the TCV?
Any advice would be much appreciated, especially as I believe I am in the right to the tune of a lot of money for a delay of 24 hours for a 4000mile flight.

Was ATL-AMS flight to be operated by a Delta aircraft?Posts are not advice and must not be relied upon.0
-
Yes it was to be operated by Delta using a codeshare with a KL flight number.0

Delta is not an EU based operating air carrier and you were not flying from an EU airport so are not covered by EU Reg 261/2004 so there is no chance of EU compensation.Posts are not advice and must not be relied upon.0

Don't suppose I would get compensation for airline that went out of business (Globespan) ?????? We were delayed at Prague for 7 hours and weren't offered any help - herded into an area that didn't even have toilet facilities...0

Who at Globespan would reply to your correspondence ?Posts are not advice and must not be relied upon.0

I travelled with the now defunct XL airline to Barbados in 2006 and had a horrendous delay of over 24hrs. Does anyone know if I would be able to claim. We flew from Gatwick. Thanks0
