I can see your point of view but in my case Virgin delayed me (I would guess there were about 6 people in the same position as me) to accommodate 70 people off one of their other flights, that potentially saved them from having to put 70 people in a hotel (with other associated costs and possible claims) and I would have thought that Virgin would have been quite pleased to 'offer' us some compensation.0

Hi ,
I took a flight from London Gatwick to Salvador in Brazil which went via Madrid.I booked direct with Air Europa and had my tickets issued by them from their London office.Upon arrival at Gatwick I found my flight to Madrid was with the now defunct Comet Air and not Air Europa as expected.The Comet Air flight was delayed which made my connection in Madrid impossible.I was given an hotel room and food and caught my second leg flight 24 hours later to Salvador.
I have contacted Air Europa who wrote back stating:
We acknowledge receipt of your comments made on October 25, 2012 by our Web site, concerning our flight UX-7023 London (Gatwick) - Madrid February 17 2007, UX-0083 Madrid - Salvador De Bahia February 17 2007. We would like to inform you that the flight on which you had the reservation was operated by another company with which Air Europa has a code-share agreement.
We regret the delay that the above mentioned flight suffered on its departure. However, we would like to inform you that in these cases the operating carrier offers assistance to the passengers up to the flight departure, in relation to the waiting time, and depending on the distance and country of departure of the affected flight, and also in accordance to the normative in force in each case.
Likewise, we would like to inform you that in case you decided not to fly on the initially booked flight or in an alternative one, and so you decided not to use your flight ticket, you can ask for the reimbursement of the non-used flight coupons when the flight delay is at least five hours. In case you are in this situation, you should request a delay certificate to the operating carrier and address the office where ticket was issued to request the refund.
If you require further more information regarding this flight, we suggest you to contact the operating carrier of the flight.
We are sorry that you missed the flight with Air Europa on which you had a reservation, due to the delay of a flight with another airline. However, as long as both flights are connected in the same ticket, according to IATA Resolution 766, the company that has caused the incidence is the one that must provide an alternative transport to the final destination, giving assistance to the clients until the departure of the alternative flight, regardless of the reasons that caused the loss of the connecting flight.
In this case, Air Europa assumes no responsibility for having denied boarding to those passengers arriving at the check-in desk after the deadline. However, if possible, our staff will indicate that the passenger can go directly to the boarding gate, without any guarantee of being boarded, because our staff aim to provide the best service to the passengers.
On the other hand, in case both ticket are not connected in the same ticket or contract, the first company, cannot guarantee the connection, although they usually make an effort advising the passengers that are affected by this incidence. We are very grateful to have received your valued comments, due to it is our constant aim to improve our service.

I have in the meantime written to the Spanish equivalent of the Civil Aviation Authority in Madrid.
My question is as my ticket was bought direct with Air Europa who offered a flight from London to Salvador which I bought in good faith, are they responsible for my entire journey even though they chose to use a code share partner to fly me to Madrid?
I have the original ticket and there is no mention of Comet Air , the space where their name should be is blank however the other leg is shown as Air Europa.The ticket is printed on an Air Europa ticket and was purchased directly with their London office.

Is there anyone out there who can advise about what to do regarding a BMI Flight in September 2006 from Vegas to Manchester that was cancelled and delayed 18 hours. Hotel was provided but a disaster. With BMI being taken over who do we contact and can we claim regarding the compensation. Flight Number was BD752 and was cancelled due to a mechanical failure.0

Flights are cancelled or delayed for all sorts of reasons, and some of these are outside the airlines control. If flights are cancelled due to bad weather, or strikes at the French air traffic control, then why should the airline pay compensation? As someone else said earlier in the thread, we don't ask for compensation if our train or bus is delayed.

Because I have signed a contract with an airline to take me to a certain place at a certain time.
Delays and cancellation are not normally suspect to compensation due to bad weather or air traffic control strikes.
In regards to airlines going bust, especially thomas cook, the only people to blame is management, a business that once prospered but is now on the brink of collapse is a result of poor decisions at the top0 -

Does the compensation include flights where they were part of a package deal?
We had a terrible time with a delayed flight and the staff didn't even know what was going on either.
Just wondering if our situation qualifies or is it only for people who have booked a flight only?No reliance should be placed on the above.0 -

Hi, back in 2008 we went to orlando with virgin, the flight was delayed by 223 minutes.(this was verifyed on flight checker sight)
the delay was due to a breakdown , (the plane was in gatwick being repaired) I have sent a claim off to them today for 2 passengers. lets see if Richard is an honest man ?:o0 -

I was wondering if someone could answer me the question of what to do if the flights operator has ceased trading?
The airline in question is Viking Airlines, now ceased but was bought out by another company?
