Compensation for delayed flights Discussion Area

  • I read the article on this weeks email update regarding compensation with interest as in 2007 we suffered a 15hr delay in Corfu. However it was with the now closed XL airlines.

    However as we booked the holiday via Olympic Holidays who are still trading do they become liable for any compensation due or is it just tough if the airline has ceased trading?

    Has anyone dealt with a similar situation, the guide doesn't mention closed airlines but since 2005 there are a few

    I'm not the expert but as I read it, it's just tough as you have to claim against the airline.

    I was on a flight to belfast in august this year with flybe and the plane was delayed for c. 2hours then cancelled. we were put on another flybe flight, which was due to leave 2.5hours after our original flight, and the second flight itself was then delayed by about an hour

    my question is what do i/can i claim for? is it compensation for the delay of the second flight (short haul, under 2hours, thus £100 - per MSE article?)

    secondly the reason for the original flight delay then cancellation was a technical error - not sure why the subsequent one was delayed, possible a knock on of getting people from the first onto the second. It seems the technical plane fault isnt something they can hide behind as an extraordinary circumstance from my reading of the cases/this thread - can anyone confirm please?


    finally, i imagine no airline is going to play ball - has anybody had any success?

  • I have just looked up my recent flight home from Cancun - the website assures me we were 177minutes late, meaning we were 3 minutes under the time limit for compensation. I guess there has to be a cut off somewhere, but it seems highly suspicious to me! Has anyone else come across anything similar?

    So the bottom line is your original flight was cancelled and you arrrived at the destination more than 3 hours late

    IMHO No: Claim is for original flight that was cancelled and you arrrived at the destination more than 3 hours late = £200 per passenger.

    Technical faults CAN be a valid claim

  • I would like to thank those for their input on this thread. Being a newbie it's all a bit daunting but going to try and find our booking reference from June 2011 and then send a letter off with fingers crossed.

    We were delayed about 4 hours, but I know it could have been worse as Gatwick control tower was hit by lightening about 20 mins after we eventually took off......

    Hi everyone

    wonder if I can have some advice about making claim in august 2010 I book a holiday for 2 adults and 1 child flying with Kiss airline. On the morning we were due to fly company went bust but told to turn up at airport. When we got there airline told us holiday was still going ahead n we were safe as our flights would be there when we returned 2 weeks later. However whne we turned up for return flight all flights were cancelled we were giving nothing to eat or drink for nearly 24 hours ( and as you can imagine after 2 week holiday not much money !!). Finally a plane arrived to take us home not to newcastle but to Gatwick where a coach returned us home. As you can imagine a lovelyt holiday ended up in anightmare!!!

    Can i claim compensation and how would i go about it please ?
  • Hopefully MSE will issue an update/correction on this point very soon. The Limitation Act section 5 is very clear on this aspect (Actions founded on simple contract).

    My brother in law the solicitor said he will look at this more but meantime I read him your message. I quote him.

    "refer Cyberlawyer to s.28 of Limitation Act 1980 and tell him to apply this to your kids claims if Cyberlawyer thinks this is an action founded in simple contract".

    He asked whether you are a lawyer and, if so, which type?
