  • Thank you to Blindman and Centipede100 - for their priceless input.

I've just come across this via Martin's email. After a lot of research I found our flight (the wife and I) from Heathrow to New Delhi (Air India) was delayed by 205 minutes in 2007.
I remember the delay as we were travelling to a friend's wedding in Goa. However I have no evidence of the flight - no booking reference/emails/tickets - nothing.

Can we still claim against Air India?
Does the lack of evidence put us at a disadvantage?

    Thanks in advance.

My brother in law the solicitor said he will look at this more but meantime I read him your message. I quote him.

"refer Cyberlawyer to s.28 of Limitation Act 1980 and tell him to apply this to your kids claims if Cyberlawyer thinks this is an action founded in simple contract".

He asked whether you are a lawyer and, if so, which type?

So if he's so clever why are you asking on here?

Centipede100 is giving FREE advice (does your brother?) which as his sig says
My posts are just advice, nothing more nothing less. What you choose to do with them is up to you.

Long way to go I think...

A LOT of the answers to questions asked here can be easily found in the MSE article TBHO and in this thread.

If you ask for an opinion on any Internet forum-don't complain if the answer you get is not what you want to hear.

    Depends what caused the delay.

    Yes

    Thanks in advance.

Bottom line, you got there, had a good time and came home.

After 5 years I'm sure the delay has paled into insignificance

    BTW

As what blindman has said, go seek advice elsewhere if you are not happy with the advice given on this forum, everyone is just trying to be helpful

Had a quick read through the guidance, we were delayed by 6 hours in 2007due to the fire around Dubrovnik which delayed all transport. Am I right in my reading that we can claim a refund for this even if it is out of the control of the airline?

  • Really, and in which court of law have you heard that?!!

I'm not sure what you are getting at???

If a mechanical fault isn't serious to prevent a flight taking off, then it would take off. If it is serious enough, then it is for safety reasons....common sense.
