Hi there Money Savings Expert
Well the good news is Virgin have offered me compensation :j, however the bad news is its for under 4 hours.
My flight was due to arrive at 17:10, the historical flight data shows touch down at 21:00. I'm pretty sure we were over 4 hours delayed and thought I read somewhere the airline can't claim touchdown time it is when the doors are opened. Is this correct and is it worth appealing to try and double my compensation? Is there a case I can quote to help my case please?

3.3.3. Measuring the delay at arrival and concept of time of arrival
The Court has concluded that the concept of ‘time of arrival’, which is used to determine the length of the delay to which passengers on a flight have been subject if arrival is delayed, corresponds to the time at which at least one of the doors of the aircraft is opened, the assumption being that, at that moment, the passengers are permitted to leave the aircraft.The Commission considers that the operating air carrier should register the time of arrival on the basis of, for instance, a signed declaration by the flight crew or handling agent. The time of arrival should be provided free of charge upon request to the national enforcement body and the passengers where the operating air carrier seeks to rely on the arrival time as evidence of compliance with the Regulation.
Based on Case C-452/13, Germanwings, ECLI:EU:C:2014:2141, paragraph 270 -
if you post your flight number and date someone should be able to post the on stand time which will give a better indication..0

Thanks for the info, I'm going to try and get additional compensation, nothing ventured and all that! Interested in your views if they turn me down.
Of interest is the historical flight data which has a log of events which states 2100 wheels down, actual runway arrival changed to 2051!!!!!! :mad: seems pretty deceitful to me, will wait and see what they come back with.0 -

It was just approaching the gate at 01.00 UTC on 2/9/14 when radar coverage was lost, so 1st door open time would have been at about 01.05 UTC or 02.05 UK time I believe.
Aircraft was G-VAST, a B747.Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -

Some advice please, because I've used the Resolver tool but I'm being fobbed off my Air France and Air Mauritius are ignoring me. This has been going on since August...
When checking in at Mauritius Airport (MRU), the Air France/Mauritius employee could not give me our boarding passes for our connecting flight from Paris (CDG) to Manchester (MAN). She did not explain why but assured me it was normal and I would have no problems collecting them in Paris. Due to the delay of our MRU flight, my 7 year old son and I did not have the time to collect our boarding passes in CDG and make our connecting flight.
We were booked onto a flight to MAN scheduled for 12.50pm which was also delayed by 30mins, meaning my son and I were waiting for for over 5 hours in CDG Airport. We were given €30 for food and beverages for that whole time, which is insufficient considering the circumstances.
Is it Air France or Air Mauritius?! Either way, my son and I were stuck in Paris CDG for 5 hours waiting for flights!!0 -
I think you will be out of luck for EU261. MRU being outside the EU and travelling on a non-EU airline.
Air France are not responsible to compensate you as you failed to present on time (due to the earlier delay)
Does your travel insurance pay anything for 5 hour delay?
Had you been on the AF flight from MRU-CDG you 'may' have been entitled to compensation depending on the reason for the delay.

Ryanair flight delayed over three hours. Tick all the boxes to claim under the EU ruling. Read Vauban’s guide. Ryanair state the delay was due to ‘air traffic restrictions which were outside of our control’ No explanation as to what these were.
The pilot told us at the time we had missed our slot for take off and had to wait for air traffic control to allocate another slot.
Advice on taking this forward please.

So on the face of it, it does look like you may not qualify. I guess the issue here is if that was genuinely the reason, or are RyanAir trying to pull a fast one?
Have you tried putting your details into one of the flight compensation checkers like from Botts and see what they say?
If that comes back and says you are eligible, I would persue and if you have twitter, use that to RyanAir too (That worked for me) and don't give up. The worse case is that you can ulltimately use a NWNF service from Botts and let them deal with it. You will lose some of your compensation, but some is better than done?
Hang in there and don't give up.0
