Compensation for delayed flights Discussion Area

Just seen a post by Tyzap and ADR. I am assuming that if you go to arbitration depending on which airline you are claiming against you can use either CEDR or ADR depending if they cover your airline, so if you are claiming against Ryanair you use ADR and if you are claiming against EasyJet you use CEDR is that correct?0

Yes, I belive so.
The CAA website has a list of which airline is signed up to the different schemes.
But knowing the CAA, its proabably wrong...If you're new. read The FAQ and Vauban's Guide

Totally agree with your last part (train delays) as a result of cancelled then subsequent delayed South Western train I missed a flight connection (last one of the day) at Southampton in May, ended up stuck in Southampton overnight then train home next day total spend £180+ compensation off SW rains £15Trollydolly wrote: »He arrived alive and didnt have to travel on an aircraft with a technical problem that could have caused a fatal crash.
Personally i think thats a good thing. Airlines dont cancel or delay flights without a good reason, Do you think they want to pay out to all these passengers?? NOPE
I know i would rather get on a safe, late plane than a dangerous on time one.
Another question id like answered , Why dont we get compensation from the rail company's when the trains are late??? How can they let people randomly walk around or have no seat when the trains moving at such speed. You have to have a seatbelt in the car and on planes, why not on trains???
Anyway i digress!
Sorry ignore my last paragraph its totally off topic0 -

After taking advice on this post my daughter contacted Flybe and they have come back with an offer of £150 so she has rejected this and quoted EU regulation so we'll see how that goes.0 -
So, when you have been through the process of filling in the claim form on their websites and had a rejection you ask for a deadlock letter and go to one of the 2 arbitration companies, then if you don't like their decision or the airline still refuses to pay then you can send an LBA/NBA and start down the court route. I know you are not a big fan of arbitration.0

Thats it in a nutshell.
I think you can also go ADR route if you haven't heard from the airline for 8 weeks.
I think the problems wwith ADR are 3 fold:
1. Interminably slow process. Deadlines come and go without any action, despite prompting.
2. Seemingly random decisions some of which are patently wrong.
3. The apparent lack of enforcement and/or inclination of the ADR to act on any airlines that don't play by the rules. If you're new. read The FAQ and Vauban's Guide

I agree.
Alas the CEDR as a tardy as the airlines.
I've only gone that route to see how the process works (or doesn't as the case may be) and report back to the forum.
However, Iam increasiingly likely to being going MCOl. Its now 3 weeks since I heard anything from CEDR despite a prompt. If you're new. read The FAQ and Vauban's Guide

People who work with my wife know I do this and have asked for help
so I am brushing up on things. In the end, they might have to use a no win no fee solicitor but if I can help them getting compensation before the court process I will.0 -
Hi everyone.
I booked up to go to New York for my wife's birthday in Feb.
Norwegian have since pushed my flights (both out and in) back by exactly 24 hours.
I unfortunately got the hotel on a deal which has no cancellation on it.
I have contacted the hotel to see if I can push the whole booking back a day (unlikely given the type of offer). We were supposed to be flying back on valentines day, so I could see it that even if they agreed to change the dates, there would be a fairly large charge on the valentines night room.
I would still love to go. The actual pushing back of the flights are fine if the hotel is ok to push the booking back as we already have the time booked off work.
If I need to book an extra night in a hotel (whether this or another one), will I be able to claim this against my flight operator? I have not accepted the flight changes yet.
Cheers
