My story started in March with first letter and the long 40 day wait. Then reminder letter and another wait then decided to ring them and threaten them with reporting them as they are witholding my information. Cheque for £10.00 was never cashed but over the phone he said he would send out the list of all my charges free of charge. He didnt give me a time frame for this so last week I rang again and over the phone I agreed to the amount of £145.00 (I only had a couple :D :A ) and this has now been paid :T

I can't believe I finally get to post on this forum. I know I probably should have held out but I am one of the lucky ones and I sorted out my debt a couple of years ago so this is a bonus.
They held out for what seemed like forever, I sent my court bundle (Thanks to CAG) in last week. I had a court date for August.
This site and its posting helped me to keep my nerve and I can't tell you how good it feels!
For those of you still holding out I say stick with it.
Thankyou Martin for providing the template letters and this forum to air our questions and successes.:money:

    Bank: Halifax
Amount claimed: £1320 including court fee and interest
    Amount won: £1120

I had to get as far as the court stage as they ignored most of my letters and just sent me the standard complaint letter saying no. I sent about 10 requests for missing information that they didn't provide but all were ignored. Eventually I just estimated the missing amount!

I put in the claim at MCOL and Halifax acknowledged with intent to defend the full amount. One day before the deadline to enter the defence they sent a letter offering £1120.

Still in two minds whether to tell them I'm accepting it as part payment or to just take it!

I'm absolutely over the moon, the whole process has taken MONTHS with Halifax dragging their feet at every stage (as usual). Now I can pay off all my credit cards and a big chunk of my overdraft.

Thanks to everyone on here, your success stories have kept me going these last months! Don't give up, stick it out to the bitter end and they always cave in!! :rotfl: :rotfl:
  • Bank: Lloyds TSB
    Amount Reclaimed: £535
Amount Won: £535 (plus £80 court cost)

Got to the stage of getting a court date for end of Aug, then just got a letter from the bank offering to refund the full amount.

    Cheers Martin!

    Bank: Barclays
    Amount Reclaimed: £340
    Amount they paid: £255
    The story:

I went as far as having to write two letters, first one requesting statements, second one requesting the money. The first letter was sent on 6 March and I'd had two letters from Barclays in the meantime saying they were dealing with my request. I've just had the letter offering £255, dated 2 July and I'm going to take it.

However I've just called to reclaim a £30 paid referral charge I had last week and they said there's a 90% chance of me getting this money back due to just having been through the above process.

Thanks for the success stories - they are what pushed me into making my claim.

Now... can anyone recommend a good loan? I want to clear my £3.5k overdraft!!!!

Started the process in Feb 2007 with Abbey National
Claimed: 4576.73 (with interest & costs)
    Repaid: 4000.00
Offer letter received after I sent them a letter saying was willing to settle out of court. First offered £3430.00 but phoned up and said they lowest I would take is £4000.00. they accepted this without negotiation. Really happy cos I was getting fed up with the wait and the stance taking from both sides.
they are actually OK to talk to, and seem to want tis whole claim thing over and done with. i suggest that if you want to settle before court, try make a settlement soon after you receive their defence.

    Halifax
    Claimed: £2900 plus interest
    Received: 2900 plus interest! Great!

I took out proceedings on 11th May and I've checked my account today and the money has been transferred direct to my account.

I just followed the process exactly as Martin says. I did get the letter saying that they need eight weeks to look into it - I was polite and waited 2 weeks before going through Money claim! Halifax applied for the additional 28 days but then I received a letter this morning saying that although they are not admitting liability they will reimburse the full amount. Excellent.:rotfl:

    Nice one Martin your'e a star.:A
