Just rang Bank of Scotland to re-negotiate and I was successfull!!!!!!

Got the usual fob off letters but decided not to go to court but sit it out and see what they'd come back with after their 8 weeks, which was 50% of my claim, just called and upped it to almost 100% (inc interest!).

The story:
I just want to say to everyone DON'T GIVE UP. I nearly did a few times (especially when it got to progressing to the court stage), but am now VERY glad that I didn't.
I started chasing my charges in Feb 07. I had to request details of all the charges twice & didn't receive them until April. I requested the charges plus interest back immediately and received a fob off letter ("...satisfied that the charges have been correctly applied to your account.."). I then sent letter threatening court action & received yet another fob off letter suggesting I contact the Ombudsman (this is now into June!). I instigated court action on 4th June. HBOS had 14 days to respond. On the eve of day 13 they Acknowledged the claim (which gave them another 14 days to respond). Having read all the other threads I was tempted to phone them and negotiate, but decided that I may win by default if my claim was 'forgotton' in the pile of other claims. I sat tight.........
Yesterday I received a letter stating that due to the cost of defending the claim Halifax would be reimbursing the full claim, plus interest and court fees. they will be paying it directly into my account within 5 working days. Hooray!!!:j
PS I've just checked my account and the money is there!
Does anyone know if I have to write by snail mail to the court to stop proceedings or can I do this online?

Hi - started claim with letter template from Martin 12 March 2007, follow-up letter, both answered with standard 'we are within our rights go away letter from Nationwide - issued court claim on-line 15th May 2007 - bank defended whole amount then sent letter on 6 Jun refunding charges and court costs - ignored interest amount.

After my first letter they offered me £ 125.00 as a goodwill gesture , I wrote to them accepting only as partial refund.They wrote to me saying that they wont be increasing any payement . I done a mco and after a week i recived a letter that a cheque for the full ammount was in the post and that I should stop wasting court time. I have now recived the cheque for the full amount and this is thanks to Martin0 -

The story: Started the process in April by sending the template letter from this site. All I received was a standard letter telling me they were looking into my 'complaint'.
Heard nothing within 2 weeks, so sent the 2nd, then 3rd letter offering a reduced amount for a swift settlement. The bank was so inundated with complaints they couldn't respond even if they wanted to.
Having heard nothing, again, I called the bank to make the offer in person. I was told by the call centre girl that she would get a manger to call me, as it's unusual to get a customer calling up to request a settlement. The call came, but it was the same call centre girl again telling me that an offer will not be made as the bank have (under FSA rules) up to 8 weeks to respond.
I unfortunately wasn't in a financial situation to pay the £120 fee the Moneyclaim site wanted, so thought I'd ride out the 8 weeks and see what happens. Nothing came, so ON THE DAY the 8 weeks were up, I called them and they told me the letter had been sent with an offer of £4010 !!!
I never gave up, I knew what I (we) were doing was the right thing and justice has prevailed.
Thank you Martin, to the rest of the contributors and best of luck to all those currently feeling in the dark.
The money will be in my (previously overdrawn)account within 10 days. I somehow feel if I didn't call them up, the response may have been different.

Bank: Natwest Credit Card
Amount Reclaimed: £250 initially
Amount they paid: 100% + statutory interest + court fee = £400.
The story:
- Usual letters sent as per MSE and CAG guides.
- They offered next to nothing and refused to budge.
- Proceeded via Moneyclaim on-line.
- They acknowledged and said they would defend.
- 2 weeks later got a cheque with letter saying the usual... they accept no fault, I had no case... but it was not economically viable to go to court.
Yippee. Another success!
If you have a 'small' claim, like under a grand say, take note of the above response I got. Stick it out and gt it all backNice 1 MSE - again!!!
Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.

After my success with Barclays and reclaiming nearly £4000 and Halifax £270.
I started a claim for my partner of £900 from Halifax.
I sent all the letters had the usual letters came back saying ‘how wrong we all are and how right they are’…Yawn Yawn Yawn. So I called them gave them the riot act reminded them of the law and was told they would send my complaint higher and it would take 2-4 weeks for a reply.
Yesterday she got a letter offering only half the amount. So I phoned them and told them we have a small problem, as I have just returned from the local magistrates after handing in the N1 claim form.( I hadn’t ..I had just returned from my local Tesco store.) and then it all changed…” ok then sir on this occasion we will settle for £945.
Result :TNot just a white vanman:cool:

I was very dubious about getting this money back from natwest current and credit card account but made a joint offer and sent a letter to each department claiming the total of £530.49. credit card department sent me an offer of £16. Current account didnt even bother to respond. Wrote back credit card dept. telling them how insulting their offer was. Posted Letter to OMBUDSMAN today, got offer letter from current account dept. for £530.49. Will accept. thanks to all for helping especially as i was on the verge of getting one of those crookish companies to do the job. well 25% plus VAT was too much for me to give away.0 -

THE STORY
I was based in bosnia for 4 years the army paid my money in on the last day of every month the credit cards took it out 2 days or the day before some some master plan they had devised and would not budge on the payment dates so i got hit double time every month! NOW ITS MY TURN!
