Default Reclaim Unfair Bank Charges article discussion Part II

This is a continuation of original bank charges discussion thread. (This hasn't been restarted because of a new article - the old one got to long)

This thread is specifically to discuss the content of the new updated article

Please note if you want to discuss 'the rights and wrongs of reclaiming charges' this isn't the place - this is a practical thread instead do it here

***** Want to tell your story in a newspaper/on TV? *****

Hi all. We need your help.

Bank Charges is often in the news and we are frequently asked if we have any MoneySavers that are willing to tell their stories to the press.

If you'd like to help spread the news and encourage others, please e-mail casestudy@moneysavingexpert.com (sorry but we can't answer questions at this email address) with as much of the following info as you can:

* what stage of reclaiming are you at - had money back /on hold / not yet claimed
* how much is/was your claim for
* who is/was your bank
* a daytime phone number - we often need to reach people at very short notice
* whether you are happy to appear in the papers,tv or both
* where you live

Many Thanks. We really appreciate anyone that can help us with this.

Default County courts system 'in chaos'

In view of the recent Lloyds Bank success (maybe - maybe not), have a look at this

County courts system 'in chaos'
http://news.bbc.co.uk/2/hi/uk_news/6353597.stm

It is vital that you ensure all your information is correct when using the County Court System.

Reading the above shows that even if you are right, mistakes are made in the County Courts and you could fall foul of them

Hi all,

Update on my claim, got statements online and worked out charges to £3368 sent first letter claiming this plus interest on 05/03/07, recieved usual letter from Mr Langdale, dealing etc etc on 16/03/07, made a couple of phone calls but didn't follow up due to lack of finances and did not want to threaten court and not be able to follow it through, when finally in a position to carry on it was about 7 weeks after first letter, looking at a lot of hsbc threads it seem that people were filing online then getting offers after about 8 weeks, so thought would leave it for the 8 weeks, Hsbc stated that they started investigation into complaint on 12/03/07.. made phone call on 08/05/07 ready to carry on and was told that a offer letter had been sent that day, recieved letter dated 08/05/07 on 10/05/07 offering £2830.93. Phoned leeds on 14/05/07 to be told that it could not be discussed over the phone and i had to sent a refusal letter in and it would be reviewed. not happy with this phoned again about an hour later and different person told me that they would put me on the ringback list but it would take up to 48 hrs. Phone this morning and was told that I was on the ringback list but it was only put on it on 15/5/07 so expect a call tomorrow... 20 mins later recieved call from hsbc to discuss claim, told him i was not happy with offer and that the £85 of charges that they said I had been paid back I had not, he rechecked it for me there and then and apologised and said they had made a mistake, then offered me £3000, asked for £3300 and he said he could go no higher then £3000 as they will not pay out more then 90% of a claim, I said come on this is a negotiation and said i would be happy to settle at £3150, he said i bet you would, then said ok and he will get the offer out in the post today and expect to recieve it in 2 or 3 days.... I make that about 94%

Seems HSBC are making a offer after 8 weeks, but if it goes to the court stage then they get their hard heads on and see it through for as long as they can.....

Will post on the success thread when monies safely in my account....

Please read Martin's blog regarding yesterday court case with Lloyds.

http://blog.moneysavingexpert.com/?p=457

and the resulting discussion thread is here...

http://forums.moneysavingexpert.com/...73#post5194473

and I'll get back to the old Discussion Thread questions later

Please be aware the above link about courts in chaos is from February and the courts are doing all they can now to get cases through in a timely fashion.

Hi

Can anyone give me any advice?
I started my claim in March 2007. Last Friday I received a copy of the banks defence (from the bank themselves). MCOL states defence received effective 13/04/07 and I can go no further with my claim online. To date I have received nothing in writing from the court. Does anyone know how long this usually takes?

Also can anyone advise me as to what I should take along to the hearing once it is happening?

My bank is Abbey and the amount I am trying to reclaim is £2704. If anyone else is battling Abbey or sucessfully done so please get in touch so we can compare and maybe help each other along the way. It is quite un nerving to think that the average Joe Bloggs is taking a massive company to court!!!

Thanks very much

You'll find the thread for Abbey linked in the Reclaim Help Thread which is linked in my signature along with links to other relevant threads.

Hi
Not sure if I have got this query in the right place! If not I am sorry!

Further to my post earlier today on the now closed thread. I am still shuffling reams of paper and pouring over this Website in an attempt to prepare a case for the County Court that my son is facing because Barclays Bank have pre-empted my action of claiming from them and have issued a summons for court which of course we will be counter-claiming.

QUESTION...Having read "what you can claim and what you cannot claim", should I deduct £2 to £2.50 from every Direct Debit charge (usually around £20 - £30) to avoid the problem in court where Barclays refute our accounts.

Can I, on court appearance, ask if there is a representative from Barclays Bank other than their legal representative. I believe, that in order to save getting into the situation that the man who just lost his claim with TSB, that in the interest of justice, any financial queries should be answered by a person from the bank. If there is no representative from the bank, am I legally entitled to request an adjournment until a representative attends, or should I request that it (the bank) has no contest as where will my questions on bank charges come from?

I have worked in the Criminal Justice System for 27 years so am confident in the court room with criminal matters, however, I know little about civil matters and procedures.

If I contest the banks charges, will it cost me more than the £70 quoted on the summons?

Default Help!

I've been making a claim on my son's behalf for £1600 from Lloyds TSB. Have made the claim on MCOL, which was issued on Monday. In light of their victory yesterday I'm really worried about what information I will need to get together for court and what form of words to use. Can anyone direct me to a link which would help, as I don't want to be defeated on a technicality, I'm sure TSB probably won't cave in at the last minute any more!

Please understand that Lloyds TSB did not turn up at the case.

The Judge only met with the plaintiff and never saw the T&C of Lloyds.
The Judge made an assumption without looking at the REAL facts.

Make sure the court understands the real facts and the law behind this

hi,
does anyone have any advice they can offfer, i applied for my bank statements they did not arrive, reapplied and finally they arrived. The bank then ignored my first two letters so i started court proceedings against the natwest for £1715 including court fee.

GUESS what i have today discovered that they have submitted a defence, am waiting for the next stage. getting very fraustrated and fed up this has been going on for the best part of three months (that was when i initally requested the bank statements).
first the natwest sent me only 2 months worth, then when i re-requested they told me i had to pay a further £10, when i finally argued that with them i received them.

what happens next, they have filed a defence?
