Not sure if I have got this query in the right place! If not I am sorry!
Further to my post earlier today on the now closed thread. I am still shuffling reams of paper and pouring over this Website in an attempt to prepare a case for the County Court that my son is facing because Barclays Bank have pre-empted my action of claiming from them and have issued a summons for court which of course we will be counter-claiming.
QUESTION...Having read "what you can claim and what you cannot claim", should I deduct £2 to £2.50 from every Direct Debit charge (usually around £20 - £30) to avoid the problem in court where Barclays refute our accounts.
Can I, on court appearance, ask if there is a representative from Barclays Bank other than their legal representative. I believe, that in order to save getting into the situation that the man who just lost his claim with TSB, that in the interest of justice, any financial queries should be answered by a person from the bank. If there is no representative from the bank, am I legally entitled to request an adjournment until a representative attends, or should I request that it (the bank) has no contest as where will my questions on bank charges come from?
I have worked in the Criminal Justice System for 27 years so am confident in the court room with criminal matters, however, I know little about civil matters and procedures.
If I contest the banks charges, will it cost me more than the £70 quoted on the summons?0 -

I've been making a claim on my son's behalf for £1600 from Lloyds TSB. Have made the claim on MCOL, which was issued on Monday. In light of their victory yesterday I'm really worried about what information I will need to get together for court and what form of words to use. Can anyone direct me to a link which would help, as I don't want to be defeated on a technicality, I'm sure TSB probably won't cave in at the last minute any more!0

Please understand that Lloyds TSB did not turn up at the case.
The Judge only met with the plaintiff and never saw the T&C of Lloyds.
The Judge made an assumption without looking at the REAL facts.

does anyone have any advice they can offfer, i applied for my bank statements they did not arrive, reapplied and finally they arrived. The bank then ignored my first two letters so i started court proceedings against the natwest for £1715 including court fee.
GUESS what i have today discovered that they have submitted a defence, am waiting for the next stage. getting very fraustrated and fed up this has been going on for the best part of three months (that was when i initally requested the bank statements).
first the natwest sent me only 2 months worth, then when i re-requested they told me i had to pay a further £10, when i finally argued that with them i received them.
what happens next, they have filed a defence?0 -
Am worried as I have been trying to reclaim charges since Feb against Natwest, they sent offer letter on day they acknowledged a claim had been filed against them, they are now saying will defend the claim and have another 28 days, so new court ruling is worry as I have refused settlement as the claim had been started. Any advice0
