    To Edinburghlass,

    Sorry to be a pain and ask this question again (think it fell between the Lloyds court case posts so quickly disappeared), but was wondering if I can claim on a bank account and credit card that was kindly closed by Barclays approx 10 years ago as I have all of the account details? I did read somewhere about a 6 year period, but is this set in stone?

    Cap1 told my husband a refund of £322 was to be on his account on the 17th May. When it did not arrive today, we got a letter in the post - usual blah blah, - we have the right to charge etc.................

    Accompanying letter says to get your money refunded £322 you have to sign as a closure of complaint. NO WAY!!!!!!!!!!

    Sending a part payment acceptance letter. I want to send a letter reporting them to a governing body for their deceit over payment of this - can anybody tell me if its the OFT, or the FO or the FSA.

    Not sure?????????????????????????/

    I believe you can but they won't send you the information/statements as they will say it is outside the 6 years but if you have the statements you can try.

    if every one has to or wants to move banks surley the y will end up with roughly th same amount of accounts but with different names,and a lot of work regarding dds sos.is there a bank or building society out there who as actedfairly towards its customers , i would change to them? how long will it be before a bank holds its hands up says sorry and pays out without court action,adjusts theircharges inthe hope most people would join them because they are fair. i would.?

    Is anyone aware of how efficient Halifax Plc are at refunding bank charges, are they reasonable prompt or not??

    ALSO, where can I locate the info on the law, IE:
    "Charges may not be more than the actual cost"

    Unfair Terms in Consumer Contracts Regulations
    The Unfair Terms in Consumer Contracts Regulations 1999 (SI 1999 No 2083) provide that a term which has not been individually negotiated in a consumer contract is unfair (and hence non-binding on the consumer) if, contrary to the requirement of good faith, it causes a significant imbalance in the rights and obligations of the parties to the detriment of the consumer.

    Under the Regulations, the Office of Fair Trading (OFT) has an obligation to consider any complaint made to it about the fairness of any contract term drawn up for general use. OFT may seek assurances and, if necessary, injunctions against those using terms which it considers to be unfair. Certain other named bodies are also empowered to seek injunctions against unfair terms.
