    Did you take them to court? If not, do so, and if you have started proceedings and they have told you they would settle prior to going to court and subsequently haven't done so... I'm not sure how you would go about re-submitting the case, but I'm sure there is a way to do that. Do you have it in writing that they said they would refund the £322, or was it a telephone conversation? If you do, then you have every right to get them to pay it back. Either way I would take it through the courts.

    I have asked a number of things on this forum but got very few answers back if any at all?

    1, Got my default charges today and just added them up, they come to just under £5,000 and with interest there over £6,000 if i have to take them to court, what way can i claim as the small claims courts are only £2,000 in N Ireland?

    2, Can I claim back (charge standing order recall)?

    3, Hi I’m trying to claim back late payments of Sterling Credit, this is a loan I had out a few years ago and has been paid back in full. I sent my first letter of 05/04/07 form my default charges received them 24/04/07, I then sent my second letter of 24/04/07 asking for £272.76, this is the letter they sent back today 02/05/07, what should I do next?

    Thank you for your recent contact informing me of your complaint. I am concerned to learn that you are unhappy with Sterling Credit Ltd and the administration costs debited to your account.

    I have taken this opportunity to review the background of your complaint and have given careful consideration to the comments you have made and all of the information available to me. Having completed my investigation , I am unable to uphold your complaint and have summarised below the basis on which I have reached this decision and hope that my explanation clarifies matters.

    Default charges are charges payable if customers do not make the required minimum payment by the due date, if they exceed their credit limit, or if, payment is not made on time, or is returned unpaid. The amount of these charges, and the circumstances in which they are applied, is set out in clause 6 of the terms and conditions of the agreement and the customer tariff of charges sent to you from time to time as revised. We believe that Sterling Credit Ltd's charges to customers are fair and reasonable.

    In April 2006 the OFT published the findings from it's enquiry into default charges payable in respect of credit card accounts. Sterling Credit Ltd has carefully considered the OFT's publication but does not accept the principle that its findings apply to your type of account. Accordingly, I regret that we are not prepared to make any refund of the default charges payable or provide any compensation.

    It is important that your issues are fully addressed. Therefore, if you have any further queries relating to this matter, or remain dissatisfied, place do not hesitate to contact me and I will arrange for your complaint to be escalated. Alternatively, you may follow the steps detailed on our internal complaint procedure, I would also like to advise you that unless I hear from you within the next 8 weeks, I will assume the matter is resolved to your satisfaction and my files will be closed.

    4, I sent all my letters to CITI on reclaiming my bank charges to the LBC and today i got a reply.The reply says on the 5th April last year OFT reasoned that their charges where to high so they lowered their charges to £12 in june 2006.They also claim that when challenged in court in over a dozen cases the claims have been dismissed and the judge has ruled that £12 is a fair charge in CITI favour. What should i do now? as i'm from N Ireland i'm a bit worried about the N Ireland case that was defended.

    Just Wanting A Few Apinions I Sent Away For My Bank Statements A Few Weeks Ago When Got Them Back Worked Out The Charges Were £2106 Got A Letter Yesterday With A Cheque Which Was For £42 Which I Think Is Totally Unreasonable Just Wondering What Kind Of Money Would Be Seen As Reasonable The Bank Is Norwich And Peterborough

    It must take ages to type when you capitalise every word!!:confused:

    With regard to your offer, I don't recall hearing of an offer so low in comparsison with the total claim. I would say that only the full amount is reasonable but it's up to you.

    hi guys,

    i recieved my bankn statements from Barclaycard this morning. But they are only dating back to June 2004. They said in the letter any statements prior to this date, are stored on micrfilm, and take time to search, therefore it is likely to take 6 weeks till i recieve the rest!!!

    What should i do? Should i write to them or, should i stick to my original timescale and then proceed to the next stage?

    Did anyone watch the news on tuesday night? There was a story on banks saying late penalty charges are legal!!! Where does that leave us now? Or is it all jibberish??

    Give them their 40 days and then report them for a breach.

    I was wondering if anybody could help. I am trying to reclaim a total £609.25 in bank charges from Abbey thru MCOL, which Abbey have acknowledged. Abbey has credited my account with £110 as a goodwill gesture in response to my original complaint.

    Would it be worth my while contacting Abbey to negotiate a better offer thru the e'mail address on the acknowledgement of service form, or could this be used against me later, should it reach court stage.

    Any response would be greatly appreciated

    Oooooh!! My husband just rung me at work and said that more than 20 envelopes have arrived from the Halifax, you reckon that's my 6 years worth of statements?!! WoooooHooooo!!!:T

    Just post a letter back via recorded delivery stating that you will accept £110 as part payment and you will still carry on your claim for the remaining £499.25.
