    Im not saying you're wrong, just debating the issue. However the guidance that decided not to issue me an allocation questionaire came from MCOL - Northampton and not my district Court. So this may have a knock on effect on others.

    My son sent a letter asking for repayment of charges for going over his overdraft limit at £30 per time and unpaid DD at £30 per time.

    The TSB replied, saying that these charges are not default charges and therefore he cannot claim them.

    Is this true?

    No definitely not, they are unlawful charges.

    I am assuming from your name that you are an ex/employee of the aforementioned bank!

    Perhaps you can answer when I finally get the statements requested 6th April (and again 18th April), and again via email 9/5/07 (as was told they had no request even though sent recorded), what type of letter I will initially get in response when I put my claim in?

    Will it be very defensive and a no outright - or do they negotiate? Any help appreciated!!

    ok, i am current employee, so if you have sent the first letter in then the response likely is that they are looking into your claim, then after letter 2 they will say they have weeks to get back to you. To be honest, i would say your claim your timescale. So do not let the bank mess you around and to take control back from them. Stick to YOUR timescale and you will win.

    Hi, this is my first post!
    I've got to the stage where my claim for unfair bank charges from Lloyds TSB for £7000ish (including interest and court charges) has just been issued by the courts. I'm waiting with batted breath for the outcome with the recent win from Lloyds.
    This is the scariest thing I have ever done. Many thanks to Martin Lewis for your encouragement and advice on this site. It's like your holding my hand through the whole process.

  • I am about to make a court claim on line, however I have waited more than the 14 days stated in my letters to the banks. Can I still file the claim or do i need to send another letter giving another 14 day deadline. I waited hoping for a response and to get money together to put in claim, have gone over by 2 weeks. Any advice would be welcome.

    As the ICO is sending out their complaints to the banks in batches on a montly basis personally I would be phoning/visiting daily my local branch, head office or the customer service department.

    By all means complain to the ICO but it isn't actually going to get the info much quicker unless you push them for it.
