    Hi all

I'm currently claiming back charges from Abbey, I've tottered up the claim amounts and sent them the letters. 4 weeks went by without contact and on the 5th I received a letter stating that they are still investigating and it take another x (sorry haven't got the letter in front of me) weeks.

Are they just stalling or do you think they are just swamped and I should be patient???

    Cheers in advance
    Ken

this acc is now in the hands of debt managers ltd.
is there a way around this,i wondered if i gave the option of taking them to court for the full amount. or accepting the £1000 if they were willing to send the cheque to him and not paying it into the debt managers.
anyone else out there had any luck with this one.
many thanks to anyone who picks this up. a tired mum with a hard working getting there debtfree wannabee son. 1 year since he walked away from barclayland. and not a late or missed payment since

If there is a debt on the account then any monies reclaimed will be put towards that debt so if you carry on with court there may be some money left over but its very unlikely that they will pay it out by cheque in this case.

Can anyone help - getting a little confused now! My hearing - NatWest - 4 July. I know I have to send court bundle which is all correspondence between me and NatWest/Solicitors, bank charges and court docs but just reading a thread on CAG and they give example of court bundle index which includes loads of paperwork with cases details, FSA information etc. Does this all have to be included? Im concerned that if this does go to the hearing, the judge might ask me something to do with these cases and I wont know! What EXACTLY do you say to the judge on the day when he asks the question why do you consider these charges unfair/unlawful? Do I need to know the legal jargon to answer this question. Im concerned because I think after the Lloyds ruling the other day, more and more courts will take this right up to the hearing with a defence. Would really appreciate any help as have to have my court bundle in next week. Anyone out there at the same stage as me? JG

Jayne, I know you are worrying but you have a goodly amount of time before your court date so read up what you can and have the paperwork ready that you already have and write a list of what you might need according to the court bundle.

Read the Success Stories and the Natwest thread and see what stages other people are at and at what stage they got an offer from Natwest, oh and read Martin's post concerning his Blog about the Lloyds case.

The CAG court bundle is very precise and covers all eventualities. If the banks turned up at court to defend the claims you would need a lot of ammunition to fight the bank effectively and the information you would need is included in the CAG bundle. It certainly wouldnt hurt to have it to hand to refer to if neccessary. The key is not to worry about what might or might not happen and to simply ensure you have everything you need just in case.

Try not to worry too much it isnt always so aggressive in court. You will probably be one of many cases heard that day and so the pressure isnt as great as you might think. This post shows what happened in court in a claim against Barclays and is very reassuring about the process.
Top thanks to OP showmethemoney! for her post.

Also remember that the 4th July is a good while away yet. You may receive an offer of settlement well in advance of that date. Good luck :)

You can send them the long version of the POC, in the Reclaim Help Thread and a copy of your list of charges but don't send off any originals or your bank letters.
