Hi My bank is Abbey, I am claiming £2704. I started my claim in March. First of all the bank acknowledged the claim to MCOL to get an extra 14 days instead of 14. Then last week I received a letter from Abbey A4 size. I thought great this must be an offer, at last some progress. I should have known better!!!! It was a copy from Abbey of their defence they had sent to the court. MCOL says defence lodged (13/04/07). I cant do anything else with the claim online and to date have not received anything from MCOL or any other court. How did it take for you to get allocated to Scarborough CC at this stage? What are you taking to the hearing?
I am quite worried now, especialy after the bank winning that case the other day!!!! I have been long term sick and in and out of hospital every few weeks for the last 20 months, I have lost my business through this as I cant work and life is a real struggle now. I exist on 34 tablets a day and can very rarely get out of the house (3rd floor flat)!!! I had to borrow the £120 to go through the court and now I am wondering if it going to work in my favour or not, I feel as though my run of bad luck isn't over yet!!
At least I try and keep smiling for my little girl and hope for once things may go differently than usual.

Certianly wouldn't do any harm to send a schedule of charges to the court. You may as well send another to the banks solicitors while you're at it, they nearly always ask anyway.0 -

Don't let that worry you too much. The bank got a bit lucky. The vast majority of cases have been settled in the claimants favour. Keep going and hopefully it won't be too long before you get your money back!0 -

:beer:Hi Simon 7685, i too am also battling Abbey for £5000, i was made a small offer of £875 but turned that down am now in the small claims process, abbey have filed an aknowledgement with the court and i have been told by the court that they have until 29th of this month to enter their defence. as yet i have not heard anything from Abbey i.e. another offer, so i assume they are going to take it thru the whole process, but i will not give up, they ruined my christmas last year by taking over £500 from my account in one month, putting me in a cycle of playing catch up and incurring more charges thru no fault of my own, if i have to defend my claim i am sure a judge would back me on that one. Keep fighting and let me know how you are doing with them.
Hi, It s nice to know other people are battling the Abbey, it was intersting reading what happened to you, it is exactly the same as me. They took £1000 in charges over Dec, Jan and Feb. Each time I ended up being so close up to my od limit that I had no chance and were they prepared to help? Er, NO! The only way I got out of it was to borrow £1200 from family which lwft me still £700 overdrawn but at least some money each month to try and live off.
I have never had any offer from Abbey I was at exactly your stage until a week ago when Abbey sent me a copy of their defence. I sit in limbo not knowing what happens next or how long it takes.

Send the one to MCOL then once or if the bank file a defence you can then send it to the solicitor or the bank.0 -

I am a little worried. Abbey have submitted their defence and nothing has happened since. When I submitted my claim through MCOL I didn't send anything seperately like the breakdown of sharges I was claiming, or any proof (ie statements etc). I thought that this was all done at a further stage of the process. Have I inadvertantly screwed up my own claim or am I ok?

Having discussed what is happening with various business pals, we can only see this problem growing into a huge volcano as more and more ordinary folk hear about our mission.
This is the time to tell your local MP with a copy to the Leader of the party you vote for.
You can find full information and their email addresses on the site

Just use the search box.
Then in as clear terms as possible, tell them your story and if you wish, the Bank(s) you are referring to.
ALL MP's must be made aware of the severity of this situation.
It's a simple case of a well worded email addressed to The leader of party IE: David Cameron and your own local MP.
If everybody did this, within days, the MP's would have a full picture of what is happening which I believe they do not know at present.
They want your vote and they are available to listen and hopefully react
I have just done this finishing with this paragraph ...
"Normal ordinary people are being severely damaged by this situation and the time has come for government intervention before you have a nation of debtors being robbed by the banks"

No its okay, now you need to wait to see if you hear from the bank or their solicitor and if so then you will be asked for further information. Even then don't send your "proof" such as statements just a list of your charges.
I suggested the above to the user as they had made a mistake when filing at MCOL.0
