Hello All, thought I’d post my experiences on here
I actually had most of my statements for the past 4 years to hand (sad I know) so was able to send letters straight away to Barclays and Alliance & Leicester.
BARCLAYS
£1,405 Charged
£1,264 asked for
£760 1st offer I refused
£1,080 2nd offered I refused
with county court for £1,780 inc Interest + Costs
I also asked for my statements for prior years and found more charges I’d missed during the past 4 years
BARCLAYS (2)
£175 Charged
£150 asked for
got no reply
with county court for £244 inc Interest + Costs
ALLIANCE & LEICESTER
£672 Charged
£604 asked for
but got no reply
£150 offered after I took to court for £804 inc Interest + Costs
£250 2nd offer when they submitted a Defence
but I'm holding out now for the lot! Plus compensation for closing my account!
ABBEY have still not provided details of fees, 60 days after cashing my £10 cheque, but I believe they will be in the region of £1,500+ but I threatened them that I’d assume it was £5,000 if I had to take it to court. Awaiting further reply from the Head of Complaints!

WOW! No charge for providing my fee details on a single page A4, 10 out of 10 for presentation and speed. Seems a shame to ask for the charges back.

Like I.F. they have not cashed my cheque and I was shocked to see the total charges, dating back to 2000 (hope they don’t notice that’s more than 6 years), were 4 times my estimate! They also provided evidence of manual intervention on my account as if to imply they will be defending or making an 'excess' offer (ie offer back original charge less £12)

I'm actually still paying off this debt but HSBC converted it to a 0% loan (YES ZERO PERCENT as in INTEREST FREE!) at £14.57 a month till March 2013

Still awaiting statements / details from MARBLES & BARCLAYCARD but if they are as high as Capital One I could be looking at another £1,500 between them!

Without the aid of this site I would never have dared to take on the banks. I knew I had paid a lot in charges but I didn’t believe it was as much as it was and until now I was always of the mind set that it was and unfortunate and accepted part of having debt while on a low income.

19/5 - Oops posted on wrong board (never mind) Anyway, just got statements (and returned cheque) off MarblesCharges total £450 (I'd estimated £200+) and BarclayCard have just cashed my cheque so I should hear soon how much they owe me
23/5 - BarclayCard sent about a years worth of statements and said rest would follow once retrieved from their achieves (£380 and counting!). I already had 1½ years to hand! Hi My bank is Abbey, I am claiming £2704. I started my claim in March. First of all the bank acknowledged the claim to MCOL to get an extra 14 days instead of 14. Then last week I received a letter from Abbey A4 size. I thought great this must be an offer, at last some progress. I should have known better!!!! It was a copy from Abbey of their defence they had sent to the court. MCOL says defence lodged (13/04/07). I cant do anything else with the claim online and to date have not received anything from MCOL or any other court. How did it take for you to get allocated to Scarborough CC at this stage? What are you taking to the hearing?
I am quite worried now, especialy after the bank winning that case the other day!!!! I have been long term sick and in and out of hospital every few weeks for the last 20 months, I have lost my business through this as I cant work and life is a real struggle now. I exist on 34 tablets a day and can very rarely get out of the house (3rd floor flat)!!! I had to borrow the £120 to go through the court and now I am wondering if it going to work in my favour or not, I feel as though my run of bad luck isn't over yet!!
At least I try and keep smiling for my little girl and hope for once things may go differently than usual.

Hi again, sorry to here that you are unwell. It took about a couple of weeks before we received the letter saying it would be Scarborough (after we received the letter saying they were defending).
Yes we are in quite a bit of debt and was hoping this would pay the council tax. It always seems like we have the bad luck too :cool:.
I hope we don't have to go to court and that the bank settle before hand, it really is getting scary now and confusing. We haven't received a date yet though, still waiting in dread. Speak soon.

Help, Help, Help!!!!
I love this site and have tried to give and take advice where I can. Now I am just not sure what to do or where to go!!!
Today I received notification from Northampton that my claim was being transfered to the town where I live, Scarborough. However the next sentence in the letter has been crossed out, it read;
"and note that the allocation Questionaire should be returned to the Scarborough County Court."
I then have an order from Northampton CC which reads;
1. The filing of an allocation questionaire be dispensed with in this case unless the district judge at the court of transfer orders otherwise.
Note: Any party affected by this order may under rule 3.3(5) apply to have it set aside, varied or stayed. Such a party must apply under rule 23.3 within 14 days of service of this order.
Please note that an allocation fee may be payable in this instance. Please contact the court of transfer for further details.

What exactly does this mean and what do I do now????????? I supplied nothing to Northampton when I made the claim, (breakdown of charges etc), although the bank have sent in their defence.
I am really unsure what to do, somebody please help me.

The story: Took a little persistance and patience, but finally managed to claw back all the money that left me on the brink of bankruptcy and losing my home after redundancy. Whilst life is still a bit of a struggle, I'm now debt free apart from the mortgage! Lots of great help from the consumer action group.

Please help, I was on my 14th day today with money claim online only to find that Lloyds TSB have defended my claim, what should I do take the 750 they have put in my account and cancel claim or go all the way and go for the 2225? It says it will now go to small claims court - I am scared now

It took quite a while for me to receive my bank statements and charges list from Abbey - I therefore impatiently sent off my letter for last years charges and then a seperate one for the 5 years previous.
however, my initial letters have not been responded to and for last years charges I am at the 'take to court' stage but the 5 years previous I am only at the 'threat of Court' stage
should I wait and start court proceedings altogether or do seperate ones? One is for £980 and the other for £1500.
Please advise I dont want to do one and not be able to claim back the other

Standard procedure from Lloyds, please read this thread for the wording of a letter to say you will take the £750 in part payment and will be continuing for the rest.

I would wait and do the two claims together as it will also save you money at the MCOL stage.0 -
