  • Nationwide have appointed a solicitor to defend their claim. They acknowledged the next day from issue which I thought unusual....here's waiting to see what happens next!!!!!

    They have 28 days to lodge a defence, what happens then?
  • Thanks - I'm just absolutely up to the eyes with it all now. It's taking me forever to get anywhere and the bills are mounting up by the minute. All direct debits have been returned and Nat West have even charged me £270 in charges from Mar-Apr!! Slowly sinking into the myre I think. Not happy at all!!

    Monkeybadger - I am in the same situation as yourself - HSBC have defended and it has been transferred to my local court without the questionnaire. I have called my local court - court locations and numbers can be found on the HMCS Homepage - and they have been very helpful of advising the process. I am not sure why HSBC are doing this and I have called them to find out if they intend to settle, and they have advised that the process is taking a lot of time etc as they are very busy (surprised?). Hang in there - I am not impressed at having to go to court either, but I am not for a minute going to let those idiots win! I was harassed by their collections department (i.e. 16 phone calls a day, including 9:00pm on a Saturday night) when my account was over drawn as a result of their charges (I have switched banks), which was very stressful for me, so I am determined to go to the wire with them!

    Will keep you posted.

    Banks or any other financial institutions ARE NOT ALLOWED to harrass you, there are very strict laws about this nowadays and you MUST report HSBC to the DTI and FSA.

    Hi all,

    I am about to take Lloyds tsb to court ( the recent ridiculous ruling has not deterred me at all!!!) and I have a question which I hope someone can help me with.....The amount of charges comes to £2274 and the stat interest comes to £205.06. Lloyds paid £750 in to my account on the 10th of April as a "Goodwill" payment. Upon receipt I sent them the following letter:

    I acknowledge receipt of your goodwill refund in the sum of £750.00. Unfortunately, there is still £1524.00 (plus statutory interest) in unlawful charges outstanding, which I must insist you refund to my account. In response to your goodwill gesture, I am willing to withhold Court action for a further seven days and confirm that I will accept £1524.00 in full and final settlement of this matter. If, after seven days, the £1524.00 has not been credited to my account, I will proceed with Court action as previously stated and with no further notice to you. I hope this clarifies fully my position on this matter.

    My question is how much do I claim for? Is it the full amount plus int and advise that £750 has already been paid or is it the full amount minus the £750 from the outset??? Any advice would be greatfully appreciated.

    I dont know about you guys but I think TSB is the most hard nosed bank to deal with and I am gutted that they ended up being on the receiving end of a soft judge who managed to find in their favour even though they couldn't even be bothered to turn up or submit any info in defence of their claim.

    If the £750 is in your account then you will just be reclaiming £1524 plus stat interest. The best thing for you to do is to take of £750 off the most recent charges that are located on your schedule.

    have recieved my statements from NATWEST realise i cant claim service fee which is written on statements around 2001 time but more recently i have been charged anything from £6 to £40 at the end of each month my statement simply shows my account number, is this re claimable??

    Hi everyone
    Filled my N1 form in on-line late one night about 14 days ago using the template from this site. Unfortunately I failed to notice the character changes when cutting and pasting, paragraph 3 now reads :- under the law of penalties, the charges are an unlawful ?extravagant? penalty. ( should be :- 'extravagant' ). Paragraph 1 also ends :- from the claimant?s account. (should be :- claimant's )
    Going to phone MCOL helpline on Monday , but does anyone know what effect this may have on my claim?
    RBS have filed an acknowledgement to the claim, going to start preparing for court!!

    Is it an advantage gold account? The fee for this was £6 then £9 (I think) now £12. If I go overdrawn the charge will show at the end of the month as £40 you need to deduct the £12 fee so the charge to claim would be £28.

    After the usual contact and letters with NATIONWIDE getting no success I filed a claim on moneyclaim.
    Nationwide acknowledged they would defend the claim. There 28 days is up on this Monday 21st May.
    Just received a letter informing me that they have refunded £956 in charges and £4.38 in pending charges, £120 moneycliam fees and £137 to cover lost interest
    Total = £1217.38 refunded as requested
