    Could someone tell me if when you have given the 14 day deadline but have not stuck to it because either they have not replied so you hang on a bit hoping for a reply or wait while they investigate, if that will affect any court action, will I have to issue another 14 day letter. A bit worried that i don't come out of process, does anyone have any exoerience of this

    They usually send letter saying they are investigating your complaint. It will t
    take four weeks and when the four weeks are ending,they write saying it will take some more time, so it is best to start the claim immediately.

    Regarding your reminder to the court, why don't you phone them or better still drop by and ask them face to face

    I did telephone them. It was transferred miles away, close to the Bank's Head Office.

    cannot believe it folks - Clydesdale Bank Plc have refunded me over £3400 - yipee!! This is complete amount, including interest, that they have refunded me.

    Success !! it can be done in Scotland and especially with the clydesdale bank.

    I have 2 claims against Lloyds TSB 1) £303. & 2) £650. the returndate is 13th June and the prelimary hearing 20th June. After the ruling with the judge that backed the back, I was wondering if I shoud continue or just forget the whole thing?

    I am looking for some help!

    This is for the bank in Scotland so should I give up and through the towel in!!!!

    hi, just to let you know i started my claim with halifax in feb and got the money beginning of may having started court proceedures against them with MCOL
    halifax: settled paid £2622.18:j
    lloyds tsb: £1038.83 inc interest, but claim on hold.

    The Judge should know the law but best have as much info with you.

    YES I would just confirm to Natwest that you intend to ask the court for a breakdwn of their charges

    Let them take it to the hearing .. IF THEY TURN UP

    As I keep sayng, you need to know a breakdown of their costs. On Natwest £35 penalty charges, doubt they will want to say because of the law.

    They cannot charge more than their costs and if they do, the charges are un-enforceable. Let Natwest know that you require this information.

    As Martin says on this site, Radio 2, Radio 4, GMTV >>>> The Lloyds win does not set a precendent that another bank can use. The Judge in the Lloyds case did not have the full information in front of him. MAKE SURE you have all the correct info.

    Did you ask them for the date the bailiffs would go in. You paid for the bailiffs to collect so they must tell you

  • Monkeybadger - I am in the same situation as yourself - HSBC have defended and it has been transferred to my local court without the questionnaire. I have called my local court - court locations and numbers can be found on the HMCS Homepage - and they have been very helpful of advising the process. I am not sure why HSBC are doing this and I have called them to find out if they intend to settle, and they have advised that the process is taking a lot of time etc as they are very busy (surprised?). Hang in there - I am not impressed at having to go to court either, but I am not for a minute going to let those idiots win! I was harassed by their collections department (i.e. 16 phone calls a day, including 9:00pm on a Saturday night) when my account was over drawn as a result of their charges (I have switched banks), which was very stressful for me, so I am determined to go to the wire with them!

    Will keep you posted.
