The story: Started my proceedings on the 12/02/2007 had to wait approx 4weeks to recive 171 copies of statements. Took 2/3 hours of trawling to find all the charges, which was then double checked.
22/03/2007 sent a letter to reclaim £5514.00 plus £1281.07 recieved a formated letter back saying that the financial ombudsman will allow them 8 weeks to look into our case.
Ignored this as suggested by everybody.
07/04/2007 next letter sent asking for my £6795.07 and telling them they have 7 days to reply before court action will be taken.
Recieved another letter stating that still looking into our case and if we don't have an update in 4 weeks to get back in touch.
Once again this was ignored as suggested on website.
23/04/2007 Court proceedings filed and issued and deemed to be served on the 28th.
03/05/2007 an Acknowledgement of Service was filed and stated that the Halifax was intending to defend this case. Giving them a further 28 days.
I must admit, it start to get a bit scary then. But chin up read a few more threads about peoples success stories and felt better again.
19/05/2007 letter from Halifax saying how they had intended to defend our case but due to the costs, and that they could not get theres back even if they win the case BLAH BLAH BLAH !!!!!!
They are prepared to pay back £5363.00 in charges plus £1251.29 in interest and the £250.00 court costs to a total of £6864.29.
This amount being that i can only claim back 6 years from the date of issue of the summons from the court but hey whats £200.00 between friends.
Checked bank account on same day and low and behold the monies already been deposited.
Thats my story. Now don't give in, start the fight and carry it on through. Its not hard just get support from this site or the Consumer Action Group website.

I am a few weeks behind you, having filed with mcol on 09/05 and no acknowledgement received as of yet. Hopefully same outcome.

But... you won't be able to hit the button at the w/end anyway as far as I understand and please don't be disappointed if the bank file their defence tomorrow as MCOL allows them to do this.0 -
I have completed all the forms, no reply from Yorkshire Bank, this has now
gone to the Court at Northampton who have transerred this to Wakefield
about three weeks ago ahve now received a letter from the Wakefield
court now have transferred this to Leeds what do I do please.
Can anyone give me any further advice.
I understand that this is too short, but I dont know what else to write,
please can anyone help me with this chat forum as I dont understand
how this works the instructions to me are not clear.0 -

WHAT DOES IT TAKE?????
I have written letters 17th April to First Direct, Natwest, RBOS, Bank of Scotland. Not one of these banks have sent my statements. I checked they were all signed for recorded delivery and this has been confirmed. I have emailed them all telling them their 40 days expires 27th May. What am I doing wrong?????
Anybody else have all these problems. Natwest have emailed me and said I will have them within 7 working days (ran out Friday).

I sent my first letter to the hsbc requesting my charges back to which i received a letter from a Mr langdale asking me to detail the charges, i did this and sent it in to mr langdale and a copy to my branch, 2 months have passed and they have not replied to any of the letter templates i have sent i have now sent my 120 to mcol and started preceedings, but i havent clue about what to do if the bank decide to defend do ineed a solicitor?as my wife is disabled and i have just been in a car accident funds are low so i can not afford to make any mistakes or lose,help!0

Found this information on another site - thought it might be helpful:
Since 6th April 2007, any complaint made by a customer about a business will incur a case fee. This fee is £400 and is payable by the business that the complaint is about. This is regardless of the outcome of the complaint. There is no cost to the consumer, so get your complaints in at http://www.financial-ombudsman.org.uk/consumer/complaints.htm
Maybe the banks will start to sit up an take notice if we hit them in the pocket!0 -
I myself requested 6 years statements for Natwest twice and to no avail! In the end I rang my branch and spoke to a nice young man who put the request for the statements in there and then and I received them less than a week later (in 2 lots on consecutive days). Try ringing your branch -it worked for me! Just waiting for a reply now to my claim for £1700!

Hi everyone, can anyone help me, i have all my staements checked and a letter drafted but i have two questions:
1. Does anyone know the correct address to send a claim to Abbey in order to get a reply quicker?
2. Is it possible to combine the 1st two letters into one, i.e. state on the 1st letter that I intend to start court proceedings if I do not recieve a reply within 14 days?
Any help would be much appreciated.
