    Is there any one else having trouble getting statements from halifax send first letter 27/3/2007 went the full 40 days no reply phoned on day 40 to be told not recieved my request and they were ordered then by phone recieved letter 2 days later 10/05/2007 saying further to your letter dated 27/3/2007 ( so the girl on the phone lied what a surprise ) statements ordered and i would get them within the 40 days ( letter recieved on day 43 ) phoned again on 18/05/2007 only to be told they would order them again . patients wearing very thin any advice ANGIE

    Hi ladies and gents,

    Could anyone assist me with a query? I have used MCOL to try and reclaim £2790 in bank charges from Alliance & Leicester.

    I recently took them through the court process however they did not acknowledge the claim within th 14days and I have requested judgement by default.

    This was accepted, judgement was entered on 15th May 2007 and the order was sent to the defendant.

    Does anyone know the timescales as to what happens next? and how I should expect to recieved payment?

    Any help is much appreciated!

    yipee..i have been writing to the bank since feb 2007, requesting they repay my charges but had some letters back to say they were looking into it...waited...and..waited...and..WAITED, waited a two weeks after the date they were supposed to reply still had not heard from them.

    guess what i recieved today...a letter to say they would pay me £750.00, so im taking it especially as i did'nt think i would hear from them..im happy with that

    Now still waiting to hear from the halifax, and so is my partner she wrote in feb to request copy of last 6 years statements they cashed the £10.00 cheque but she still has not recieved the statements, she's called them 3 times and each time they say they are sending them out...anyone had probs with getting there statements?

    Yes I too have had problems with the Halifax. Asked for statements in March. Took 4 weeks to cash £10 chq and after 2 or 3 phone calls I got an actual list of my charges. This took about 50 days from first request for my statements. They did in the beginning say they hadn't received my letter....funny that considering they'd cashed the chq!!!! I did the 1st template letter asking for money back based on that list. Was later told when I rang that the £10 Chq would be refunded as goodwill gesture-it wasn't, rang to ask why they didn't refund it-they had no log of that call and they wouldn't refund it anyway as it is their fees for providing the statements!!! 2 weeks later I received all bank statements which were useless as I already had a list of charges. Have been told they have 8 weeks to deal with my 'complaint' so have until June. Not good enough so I have filed MCOL last Friday. Prepare to wait as the Halifax are sooooo sloooooow.

    Freemaiden I tried with Halifax for ages just kept getting fobbed off and told to wait. I went into my local branch and within seven days I had all my statement free of charge. I have suggested this to many others who have done the same.
    So go into the branch and best of luck.

    Bit of advice please anyone

    Currently in process of claiming £3000 from nationwide. We have filed with moneyclaim, nationwide have acknowledged and now have 28 days etc. We have extremely bad luck so im positive it will go to court and positive nationwide will turn up to defend, thing is if this all happens im slightly terrified of turning up in court and facing nationwide on my own?? what should i do?? should i arrange for a solicitor to come with me, because a solicitor representing nationwide would walk all over me, im happy to go to court but unsure of what is expected of me whilst there and should i really have legal guidance??
    Any advice much appreciated.

    how did you get a total list of your charges from the halifax? do you have to send another cheque for this as the statements still havent arrived. if i call them will they give them over the phone or will they email them ? been waiting since feb just for the statements and not much i can do untill these arrive asi no longer have the statements.

    There's no need for a solicitor. One of the main points about Small Claims is that legal representation is not usually required. It is designed so a layman (or woman!) can represent themselves.

    It's unlikely the bank will turn up at court, they won't be bothered to send a solicitor. If by some small chance they did, the judge would not let them 'walk all over' you as such.

    It's a fairly informal setting with parties sat around a table. As long as you have all your evidence and understand and can explain your points clearly, you should be fine. The judge makes an assessment based on the information he has about the case.

    I too have had major problems with HBOS- still waiting.

    Sent letter requesting charges 7th April, which was recorded. Have sent sveral emails also. Been promised they will be despatched in 7 days etc.....

    To date have nothing and the 40 days are up today. So sent them yet another email today saying that they I am reporting them for non-compliance and I am giving them till Wed as a gesture of goodwill.

    Lets see.........

    Hi I recently received a letter from Halifax PLC rejecting my claim to have my charges back. I am now writing to inform them of the 14 days they have to settle before I commence court proceedings but I am unsure of where to send this letter. Do I send it to my branch again as I did with the first letter or back to the person who sent me the rejection letter?
    Any suggestion would be super helpful! : )

    I have received letter from MCOL to say the case has been transferred to salford county court and it show Barclays defence in this letter, can anyone tell me if I need to send any docs off now or should I wait untill I am asked by the court.
