    Hello all,

    I have just paid £80.00 to MCOL to take Lloyds to court for £860 in charges. This has been on going since Feb 07, went through all Martin's advice and posted 1st and 2nd letters etc giving set dates for replies and was just fobbed off saying charges were legal and that I could have checked my balance at anytime blah blah blah.

    I am very nervous now as I can not really afford the £80.00 at this time but feel I dont want to give in.

    Any advise? :eek: :confused:

  • Hi guys,
    Not sure what to do.
    I sent off my letter on the 2nd of May to say that i wanted my charges settling,or i was going to start court action.Since then i've heard not a peep.
    I had to send off that letter twice anyway as i thought i give it a second go.
    Not sure if i should try again with a lesser amount or should i get a solicitor to go the full hog, i thought they wouldcave in before this but obviously they are ignoring me.
    is there any advice you can give me as this is doing my head in now.

    hi first time post.just wanting a bit of info plz.im claiming £2100 from lloyd but my overdraft is for £2500.i have a debt management programme in place with this overdraft included in it.i was told i must stick to my monthly payments so was wondering if lloyds would take my claim to pay of my overdraft.as im not allowed to miss a payment (legally binding)surely they cannot take my charges for my overdraft.are they allowed( i need a holiday)thanks for a help.

    I have just received a letter back from Lloyds basically saying that their charges are fair and then they say in the letter to request bank statements (which i have already done). Can i claim for o/draft usage fee and o/draft excess fee? Can anyone help? Also what do i do next, not sure, letter from lloyds doesnt make sense?

    Can anyone help? I received letter from Halifax telling charges were fair. Phoned them today and the lady said they could look into it again. Was this the right way to do it or should i have just said no i'm taking you to court. I did mention that i was going to take them to court. So what should i do next?

    Can anyone tell me if am right or wrong...am sure somewhere in these threads that it was put that you can claim overdraft usage fee, this was used by Lloydstsb a few years ago.. A quick reply would be appreciated as am about to do my spreadsheet

    Can anyone tell me if First DIrect have sent them just a list of charges as opposed to statements. Have requested mine and been told the list of charges is on its way.

    Was also told when you submit it back for a claim, they will send out an offer letter with which you have to accept or reject.

    How near to the amount requested is this usually????

    could anyone help me i have got to the court part but the court are now asking for £200 wish i dont have iam a fulltime student and i cant ask my family for money i need help. what shoud i do i cant sleep at night iam panicing.

    please some advise please

Phone this morning and was told that I was on the ringback list but it was only put on it on 15/5/07 so expect a call tomorrow... 20 mins later recieved call from hsbc to discuss claim, told him i was not happy with offer and that the £85 of charges that they said I had been paid back I had not, he rechecked it for me there and then and apologised and said they had made a mistake, then offered me £3000, asked for £3300 and he said he could go no higher then £3000 as they will not pay out more then 90% of a claim, I said come on this is a negotiation and said i would be happy to settle at £3150, he said i bet you would, then said ok and he will get the offer out in the post today and expect to recieve it in 2 or 3 days.... I make that about 94%

    Seems HSBC are making a offer after 8 weeks, but if it goes to the court stage then they get their hard heads on and see it through for as long as they can.....

    Will post on the success thread when monies safely in my account....

    They came through with the statements 36 days after I sent the request to data protection, however I had to call them TWICE and on the last call told them their 40 days were up on 28th May - they arrived on the 17th all 20 envelopes - royal mail and sixing through it's slot AND today I sent off my 2nd letter requesting my balance. They told me on the !st call that they did not keep records of whether statements had been sent out and the local branch could not help me. HALifax hate me and it was like they were waiting for me to go .01 penny overdrawn and then slammed me with a letter. I really want to win them. Capital One made an offer of 'the difference'. I sent my rejction letters to them too. The other Cpital One was for the interest amount as per the calculaor - an insult to the ditress they caused me. I'm going for it.....
