I was just wondering what people are think about the case that is going on at the moment in London

Interesting… Although the bank has already paid the guys charges, he is just on a bit of a personal mission to claim “damages!” In light of his new profession it could be a very good start or good end to a new carer!?!0 -
In a nutshell:
I started my claim in Jan '07 for £2165 letter dated 14 May offering £750 full and final settlement, letter arrived 21 May money already in the bank.
It might not be the full amount but it will see me over the weekend.0 -
:T Just to say I wrote to the Alliance & Leicester for my MEAF in February and heard nothing. I wrote again at the beginning of May with the same letter and I received a reply a week later saying they were investigating.
On Friday I received a cheque for £287.50 in settlement of the matter!!!!!

How do I post my success story. I went to the hole in the wwall and Halifax have paid me £13950 -
So Mr Brennan actually reclaimed his bank charges,but know he s trying to claim damages. if he loses, does this mean that all us people who are still waiting to be paid back our charges,may get nothing?????0

I think that says it all. The outcome of this case will have no bearing on any other. Each case is tried on its own merits according to the law of the matter. I personally dont see any cause for alarm.0 -

I've moved this from the Success Stories to answer as I do hope you will carry on for the remainder of your money as £750 is a standard "goodwill gesture" given to anyone reclaiming. You need to write back and say you will accept it in part payment, without prejudice, and will be continuing to court for the remainder.0 -

They came through with the statements 36 days after I sent the request to data protection, however I had to call them TWICE and on the last call told them their 40 days were up on 28th May - they arrived on the 17th all 20 envelopes - royal mail and sixing through it's slot AND today I sent off my 2nd letter requesting my balance. They told me on the !st call that they did not keep records of whether statements had been sent out and the local branch could not help me. HALifax hate me and it was like they were waiting for me to go .01 penny overdrawn and then slammed me with a letter. I really want to win them. Capital One made an offer of 'the difference'. I sent my rejction letters to them too. The other Cpital One was for the interest amount as per the calculaor - an insult to the ditress they caused me. I'm going for it.....0

HI I FOUND THIS AN INTRESTING READ AND TO BE QUITE HONEST ITS ABOUT TIME SOMEBODY GOT A SET OF B***S AND TOOK THE BIG MEN ON ALL THE WAY I PERSONALLY THINK FAIR PLAY TO HIM HE IS SPEAKING UP FOR EVERYBODY WHO HAS BEEN IN THE POSITION OF BANK CHARGES TAKING ALL YOUR WAGES DO BANKS REALLY THINK THIS IS FAIR TO LEAVE PEOPLE WONDERING WHERE THERE NEXT MEAL TICKET IS GOING TO COME FROM!!

Your type of attitude is what everyone needs to succeed.
This London case must be put into perspective. Natwest have already paid him his bank charges back and offered a further amount in a bribe not to go to court. The latter rather shows what mentality these banks have.
He is sueing for damages and that's what this case is all about. Tom is going a lot further than we are. If the court rules that Tom is wrong, it will be for the damages and NOT for the penalty charges.
This is still an open door for everybody. We are claiming unfair charges and the law is on our side. If the banks think we are wrong then they are all invited to give a complete breakdown of how £2 can grow into £35.
The judge in the current case must be given substantial evidence by the banks that a £35 charge is legal and not profiteering. The only way they can do that is to give a breakdown and by doing so will show they are breaking the law. It would be very difficult to believe that any judge would go against current law.
It is interesting to note that the judge suggested to Tom that he waits for the OFT to complete their investigation, this rather says that even the judge is not too sure
The Lloyds TSB case was a farce and the judge admitted that he did not have the full information.
Even in Tom's case it would be very foolhardy for the bank to disclose this information and they won't unless of course a judge demands them to do so. That day is coming fast.
