    This is my first attempt at making a post so please excuse my mistakes.

    I have been using the templates to try to get statements from Barclays - they responded to my initial request saying that I would get the information within 40 days AND they returned my payment.
    40 days passed but no statements so I sent second letter requesting statements within 7 days as per my rights under the Data Protection Act. Barclays responded 7 days later saying they are too busy and the statements should be sent out in the next 28 days. Should I make an estimated claim or wait 28 days? Are they dragging this out in the hope that things will change and they won't have to pay up?

    Advice would be appreciated as I am ready to give up but I guess that is what they want.:confused:

    BTW - Lloyds TSB have a policy in place for when the bailiff calls at a branch. Unfortunately I was reading the letter up side down through the screen whilst being served and the policy is in response to the media interest in reclaming bank charges but I coudn't see exactly what the staff are supposed to do.

    Too busy's rubbish! I'd get onto the Information Comissioner if I were you. Barclaycard were surprisingly well behaved when I requested my credit card statements. They said it would take six weeks and had informed the Information Comissioner of the timescale involved, which I believe they are required to do by law. Six weeks later, the statements turned up.

    Don't give up, please. It is a tough process, but the more people that see it through, the more victories there will be and hopefully more pressure on the banks to change their ludacris policies

    I am chasing many banks. However upon reminding Natwest via email that there 40 days expires 27th May, I received the following email: Can anybody please clarify for my response:::::

    I am sorry that you have not yet received a response from us. Unfortunately due to us experiencing larger than usual volumes of correspondence we are currently behind in our replies.



    We are trying to deal with these claims as quickly as we can and I hope you will bear with us. However in line with FSA guidelines we have 56 days from receiving your request to send a full response to you.

    Do not threaten court action and then not bother, this is what the banks are counting on. Be strong the mcol process is easier than you may think. Remember to Stick to the timescale!! Stick to your guns!!Get your MONEY back!! Read the website and draw strength from the momentum within it.

    Not quite sure, but there must be an answer somewhere within the site
    i would be on the phone to customer relations tomorrow first thing, tall them the situ and a gently mention the baliffs, it might work wonders

  • Can anyone help my friend she is trying to reclaim bank charges from Lloyds and she has now been given a court date for 2.00pm on the 25th June and it states that she needs to send documentation into the court 14 days before.

    She has no idea what documentation is needed, it states that she should also send in a witness statement but she's not sure what she should put in it.

    When I reclaimed mine (from a different bank) I was never given a court date and they paid up. Not sure what to tell her.

    Any help would be great as she is getting really stressed out about going to court as she doesnt have a solicitor or anything.

    Amount Reclaimed: £452 + £50 Court Costs
    Amount They Paid: £400
    The Story:
    23/02/07 - Requested Statements
    26/03/07 - Statements Arrived including Microfiche
    28/03/07 - Sent First Letter 14 Days
    04/04/07 - Received Letter stating that Abbeys Charges are Correct and it will take 4 weeks to get in contact with an answer
    12/04/07 - Took Abbey to court through MCOL
    14/05/07 - Received Defence from Abbey (Awaiting Local Court Date)

    Received Some Contact Number off a Friend and contacted Abbey today told them i would settle for £450 they rang me back within 2 hours and said they would offer me £340 i told her i would settle for no less than £400, they rang me back within 25 mins and the offer was accepted so i am over the moon
