thanks Beckied, imay well return the cheque,as i have tried to resolve the matter ,even saying that i would not claim the interest or take court action if they just payed what they owed me, but the cocky chap on the end of the phone wouldnt listen to reason ,he just said take us to court so i will write to them telling them that i have taken their advice ,and stuff your goodwill gesture.........but keep me informed

Has anyone had any luck with barclaycard.
I have just spoke to the department which send out the statements.
I was told that if I couldn't wait for the rest of the statements then I could do a part claim until the rest arrive.
apparently they are very behind and had to take on more staff and get more equipment for the micro fich.My Mission today is to have an opinion on everything.

I have received a General Form of Judgement or Order from my court.
It is ordered that I do file with the court, Further particulars of Claim and do serve the Defendant with the same by 6th June 2007.
The district judge requires the amount of bank charges claimed in the claim form to be particularised showing how the total amount claimed is arrived at by specifying the date, amount and type of each charge claimed.
- to me, this just looks like they need my spreadsheet of charges and the bank statements involved, but do I need to send also evidence as to why my claim is valid, and the 'court bundle' which is being talked about?
I have not been told to fill in an AQ
Please help as I do not want to mess up at this stage

barclays offered 1765 on claim of 2950 aprox in a letter. have started mcol but i feel i am starting to wain a bit. i am self employed and feel this is beginning to take over my life.every person i bump into the conversation ends up on bank charges ,by me i might add and, have started a few people on their way to claim.i am just going to ring barclays now to have a barter if i can get close to the amount say 2700 i might take it.do not think i am chickening out just weary in the face of good publicity one day not so good the next. thanks.0

Can anyone tell me how long it is likely to take for the court to set a date a hearing? My MCOL claim was transferred to my local court on 9 May 2007 and I have just phoned them because I had heard nothing. They tell me that if I have not heard anything in the next 2/3 weeks I should phone back!!! On that basis I am looking at at least another couple of months before I progress any further against those lovely people at Citibank!! I am now beginning to realise why the Banks say they are going to 'defend' claims as it substantially delays them having to cough up the money.
Can anybody advise me on their experiences, if similar0 -
in the letter of offer of 1765 they gave me 8 weeks to decide at least i have that to fall back on as surely they cannot back out of that. thanks.0

Just been looking at the successes thread its sooo disheartening how some banks pay up and some dont. My fight with Abbey has been going on since November and awaiting court date.

Hey - dont worry Im also experiencing this! Halifax acknowledged my MCO claim today so instead of the 14 days I now have to wait bleedin' 28 days. To make things worse Natwest are playing the 'dumb card' and have acknowledged nothing and havent even responded to ANY of my letters' or acknowledged the MCO claim. Nice eh? Its all part of the slowing down process - its probably the only REAL defence the banks have. Seems like the time that banks were paying out easily are over mate - looks like we may actually have to fight for it :-( sucks hey. Its just all part of the banks process of weeding out the non-committed, basically its survival of the fittest to coin a phrase. They didnt tell us it would be this difficult did they???? Im owed about £4000 by 3 banks, not one have paid out yet 2 months down the line - but I try not to think about it too much - I just know I'll get it all back sooner or later if I do all the things im supposed to.
Anyway, dont feel disheartened - im sure there are hundreds of other people in our position - stick to your guns mate. Remember that you wont be held liable for anything if it goes tits up - its just a matter of time before you get your money back - and theres like a 0.001% chance you wont get anything back if you stick to the plan.
