    Incorrect ... they've been paying out steadily in amounts under £500 and even higher in some cases. This bank do try to take it all the way though and there are loads of us awaiting court datess.

    Hi guys. i'm in need of a bit advice. sent a letter including statements re: claim for charges to local branch of lloydstsb. received a reply 14/5/07 stating that the charges are for service for going over my agreed overdraft and not 'default' charges that people pay for breaking an agreement with them. Isn't this the same thing? Are they trying to confuse me by saying they are two different types of charge? Should i continue with my claim of £800 by sending the next template letter threatening court action?????

    I am currently in the process of making a claim, I have got to the stage where I have sent the letter with the amount I wish to claim & I received a letter back approx a week ago telling me that they are looking into it, but might take up to 8 weeks to respond ....

    Anyway, I went to do a bit of shopping in the supermarket today & my transaction wouldn't go through on my card!!!! I went outside to the cashpoint to check my balance, and, although I am overdrawn I was still £60 under my agreed overdraft limit, so couldn't understand why the £25 transaction was declined & why it wouldn't let me take any money out from the cash machine?! :mad:

    Do you think this means that Barclays are going to cancel my overdraft or try to close my account down? I haven't received any correspondance to say that they are taking my overdraft away from me, or that they are reducing my overdraft - I would have thought if they were going to do that they would do it if & when they decide to pay me the money I have asked for in bank charges to clear my overdraft.

    Has this happened to anyone else? I'm just worried that they send me a letter in the next few days telling me they are withdrawing my overdraft & maybe even close my account - if they ask me to repay the overdraft in full now I have no funds to do it!!!!!!

    Any advice would be greatly appreciated!

    Norwich and peterbough did the same to me then a week later £100 was placed in my account and everything was working again . Hasn't stopped me thought still going to court as they owe me nearly £2000 with interest

    hi i had exactly the same thing happen to me with lloyds i applied for my money back on the 20/04 recieved a letter saying (no chance) in so may words on the 06/05 and they stopped my overdraft within a week or so of me recieving the letter.
    They have acctually done me a favour even though it was embarrissing to be decined and even though i was broke for a couple of weeks and had to go in to the branch and claim hardship to get my child benifit because they wouldnt wait till the end of the month till i got paid (and by law they carnt take benefits) of you they just like to put you threw hell to get your money!!
    Anyway all worked out for the best now the money in my account is mine and i dont owe the banks nothing!!!;)

    I'm claiming against First Direct too, though I am claiming for £8134. I DID include interest in that total.

    I have to say that FD are a bit of an enigma in regard to how easily they pay out. I've read many posts stating that they simply paid out after the first letter, some after the second, whilst a few went as far as MCOL claim.

    For myself, it's gone way past the MCOL stage. I was informed 11 days ago that the bank is defending my claim and that it is being referred to my local County Court (Swansea). I've not actually received a court date as yet, but it seems as though First Direct want to take this as far as they can. Think they are hoping I will lose my nerve.

    Everyday when the postie arrives, I keep hoping that there will be a letter from First Direct (or their solicitors) offering the magical 'out-of-court' settlement. But it simply hasn't happened so far.

    I will point out that I sent the very first letter to First Direct way back at the beginning of March. So you can see how much time this has trundled on for. I'm off on holiday in July and it would be nice if they would pay up before then, but the amount of time this is taking makes me think that the light at the end of the tunnel is still a long way off. As an aside, I have decided to leave First Direct and have opened an account with Alliance & Leicester. Everything should be transferred by the end of next week and so the First Direct account will be closed. I was a customer of FD for over 13 years so they will be losing a loyal customer.

    I also have a claim in against Smile. That hasn't gone as far as MCOL yet (though the 14 days is up at the end of this week). Last I heard from them was a secure message stating that the FSA allows them 4 weeks to respond to my claim and 8 weeks in extenuating circumstances. They told me that because of the volume of these types of complaints they are having difficulty keeping up and that would I really think it fair if they dealt with my claim before others ?

    Oh how my heart bleeds for them. If they hadn't spent all these years ripping off customers like us with their extortionate charges then they would not be in this situation in the first place. And they expect us to feel sorry for them ?

    Anyway, I'll stop there as this post is getting rather long. Hope this helps.
