What do u all think i am going to post in the next couple of days my court questionnaire and wait for a court date. Do you think its worth phoning Abbey up and seeing if they will settle for a lower amount.

To make things worse Natwest are playing the 'dumb card' and have acknowledged nothing and havent even responded to ANY of my letters' or acknowledged the MCO claim. Nice eh? Its all part of the slowing down process - its probably the only REAL defence the banks have.
    B

99 ... you have probably hit the nail on the head saying that.
HOWEVER, the law is on your side 100%. They have 40 days to give you the information. If they don't, they have broken the law under the Data Protection Act ..... how many more laws will they break before they are brought to justice ?

The brighter side is that they can hardly chase you for your overdraft can they when they are not supplying the info.

I said in a much earlier thread that this was a "Catch 22" situation for the banks ....... now through their own making, it's become a DOUBLE " Catch 22" for them.

If you people don't get replies, keep reminding them with recorded delivery letters and that way you'll have a signature who received it at the bank.
If you have done your utmost to get the info and the bank fails to reply, it will not go down well with a judge

hey theres a website you should use, all your 0800 local rate numbers, just type in the 08 number or name of business and it spits out their landline - pretty sneaky or what? ;-):

i wonder if this has been feature on this website as yet?
99point99 - Resurrecting the bank charges case. .

    Halifax - £428.43 Natwest - £2853
    Barclaycard - £647 Barclaycard PPI £331 Lastminute.com £110
    Ludlow Thomson £130
  • Barclays, requested info 21 Feb took well over 40 days

    Sent first letter 13 April.

    Got stalling letter as standard...

Reply on 20 May offered £615 (of the £820 I claimed plus interest.)

Have sent 2nd letter of intention to go to court, accepting £615 in part (without prejudice) but wanting remaining £205 or interest and court fees will be added, pointing out this would be better to settle and reminding them of the breach of the information request...

Time will tell! But I though £615 after one letter was good!

    Great 99 ...... I just got myself a load of 0800 freephone numbers, better than 0845 and 1p - 4p per minute

Everyone should save the site to their favourites

The story: After reading the information provided on this amazing site, I bit the bullet and submitted the first recommended letter on 14th May. I then submitted the second letter on the 19th May, after checking through my statements.

I received the offer on the 23rd May! :j

Thank you very much in deed.

    Hi
