Hi,
Advice please. I Know this is a case of personal opinion but.. I have requested £600 charges back from Capital One from a total of £714 (closer to £1000 with interest if going to court). I today received a cheque for £230.83
on a remittance advice slip, with no letter explaining why or how? Do I cash this and send a thanks for part payment but would like rest - IF SO , does anyone have a template letter for me - OR do I return the cheque to them and request the whole amount again... I was surprised to find no letter enclosed.. Couldn't decide if this is good or bad?
Thanks in advance

Hello Edinburghlass,
I don't know if you remember our little debate about claims being forwarded to the local courts and being dealt with, without issuing an Allocation Questionaire to the Claimants. So I emailed MCOL, and here is what they said with regards to all future bank charge claims.
Dear Sir,
Thank you for your e-mail. It is not the case that all claims will be transferred without the need for Allocation Questionnaires. At the moment, Money Claim Online has a blanket order for all bank charges claims only.
Any claims not issued to recover bank charges will still be transferred in the usual way, with Allocation Questionnaires.

Note: I've obviously deleted the name and contact details of the MCOL staff member.

firstly hi to all
i wonder can anyone please tell me why it seems to be some people are getting paid without a problem and some are really having to fight for it, the reason i ask is that i have been wrangling with the halifax for months i have till friday week for them to acknowlege my mcol as i filed it on 15th of may.
i did 2 template letters and had a really rude so and so talk to me on the phone, i am really worried about going into court i must admit but then i read that some are going to court and some are not from halifax , i dont understand how to one person they are saying it's not viable for them to go to court and another they are taking it all the way?
i mean would this have any bearing if i bought this up in court as evidence?
i am so confused it is consuming my every day.
i feel like they are just pulling names out at random to pay and the others they are taking thier chances.:rotfl: it's all making my head spin!!!!!!0 -

It will instead be dealt with in writing between the claimant, defendant and the Judge. I could be wrong, but I doubt the Court is lying to me.
Regards.
Thanks for that, but it was this post I was querying, AQ's have been dispensed with for some weeks to speed up the system but this doesn't mean that people won't be going to court.0 -
Just wanted to share my good news... just checked my bank and Halifax have paid in just short of 2,000.... still 3,000 short so the phone will be going bright and early tomorrow. All this 2 days after they chose to defend my claim....0
