    to me three times three banks. I just went ahead with court proceedings. it caught them offguard. Puts them in a spin.They have leaflets they sent out with their reply to complaints, stating they deal with complaints quickly. this is false information. If it takes

    happened they write again to say it will take more time.They are hoping there will be leglistation supporting them with their unlawful charges.

    I have been using the templates to try to get statements from Barclays - they responded to my initial request saying that I would get the information within 40 days AND they returned my payment.
    40 days passed but no statements so I sent second letter requesting statements within 7 days as per my rights under the Data Protection Act. Barclays responded 7 days later saying they are too busy and the statements should be sent out in the next 28 days. Should I make an estimated claim or wait 28 days? Are they dragging this out in the hope that things will change and they won't have to pay up?

    Advice would be appreciated as I am ready to give up but I guess that is what they want.:confused:

    BTW - Lloyds TSB have a policy in place for when the bailiff calls at a branch. Unfortunately I was reading the letter up side down through the screen whilst being served and the policy is in response to the media interest in reclaming bank charges but I coudn't see exactly what the staff are supposed to do.

    Do not estimate claims, it's a road to disaster.

    You can complain to the Information Commissioner, but in reality they can only slap the bank's wrists and they are snowed under with complaints because the banks are snowed under with requests.

    Technically they are breaching the DPA, but in the real world it's just a question of waiting I'm afraid.

    Don't give them anymore time, start your reclaim action by sending the first letter. They will fob you off forever and a day

  • Hiya everybody,

    Dont know what is happening with my claim as the only thing i have had from Natwest was my statements, i wrote back to them with the amount of £553.74 on the 15th April, and didn;t get a reply so i sent the follow up letter on the 2nd May saying that the have 14 days before i start court procedings and i have just got back from hols and still nothing at all. Should i start court procedings or try and get hold of a phone number and try ringing them to find out what's happening?

    Hello Everyone.

    I started my claim in February. Sent the first letter to HSBC, received the standard letter back stating that they would investigate. Second letter sent - no reply.

    Filed the claim with MCOL early April. HSBC acknowledged the claim and then submitted a defence at the last minute. (no surprise there)

    I received a 'Notice of Transfer of Proceedings' from the court stating that the Allocation Questionnaire be dispensed with in this case.

    Just been waiting for further instruction from the court.

    Got a letter today from the Local County Court -

    'General form of judgement of order'

    stated as follows -

    It is ordered that:

    1) The court of its own motion is considering striking out the defence as an abuse of process on the basis that the defendant has settled all previous claims of this nature.

    2) If the defendant objects to this course of action, it is to file at court, by 4pm. on 1st June 2007, a schedule setting out a list of all claims it has pursued to trial and all the claims it has settled.

    Has anyone else had this letter? If so, please could you let me know what happened next?

    Any other advice would be gratefully received.

    We started to panic a little last week with the person losing there case and started to think we had missed the boat.
    Rang natwest today and was informed that an offer of £2700 was on its way in the post.We had sent the letter threatening court action and heard nothing for about 5 weeks.
    Think were going to take the offer.

    was in same position however today received e mail from customer complaints offer on way in post
