    I made a claim after hearing Martin on Jeremy Vine's Radio 2 show. I used the template letter on the BBC website and sent everything off.

    It took them a while a to make an offer, so when they actually did, I accepted.
    With hindsight, I probably should have refused the first offer and would have been offered nearer the true amount owed. But when you're skint £1900 is a lot of money!!!!!

    Only other bit of warning is, that if you ever have a dispute about any other bank charges (even if completely legitimate though someone's mistake) they will not consider a refund as you have already made a claim.
    Worth thinking about.

    The story:
    Sent off all the letters and got offered £1,000.
    My boyfriend asked for £1,500 with barclays and only got £1,050.
    NOTE: Be patient, it took 6 months to get our money- just hang on in there...it's worth it!

  • just got out of court and i won my case, the bank didnt turn up to defend so the judge awarded it to me. He said they didnt apply for a 'stay' and said they dont have a leg to stand on if they apply for the judgement to be set asside.
  • Well done! Do you mind me asking which Bank were you claiming against and which court?

    It's interesting for me to hear that the judge said that they would have difficulties getting the judgement set aside - I'm in court on Monday for HSBC to state their case for my judgement given on 25/7 that they have never paid up on to be set aside.
  • it was against the yorkshire bank at oldham county court, he said they couldnt get the judgement set aside because they didnt turn up.
  • Having had our bank charges reclaiming frozen until after court case have had success with credit card charges,
    Lloyds, Barclays and Nat West paid up,
    Egg are being sent to the financial ombudsman

    Still waiting for PPI on all cards etc as self employed.

    The story:

    Took out a loan over 3 years for £3,000 in Sept 2003 and was offered an extension to take it to £5,000 over 5 years seven months later.

    Was presented with PPI as necessary for the loan, was given misleading figures about repayment amounts on the second loan and there were no eligibility checks to see if I was suitable for PPI in the first place. They even filled in all the loan documents for me, adding in of course the PPI.

    14th June : first complaint letter to branch and cancelled PPI at the same
    2nd July: received letter from Central Services - cancelled PPI and reduced monthly repayments by a piffling £7.63 instead of £30 as set out in the agreement I signed. They explained they use front end loading (though never tell their customers that) so more was paid out in the early years on the insurance policy and less in the latter years.
    3rd July: Branch Manager responded - not entitled to refund.

    9th July: took out a different loan to pay off exisiting RBS loan and opened a parachute account with another bank. Transferred all important direct debits in case things got nasty.

    17th July: second complaint letter sent to Customer Relations Manager. Added in a further complaint to my orignal set that I had been finanically disadvantaged and charged more interest over the long term by this sneaky front end loading business with the PPI. Made it clear I had removed by loan business from them and once this PPI complaint was resolved would remove my banking business as well.

    20th July: received letter to say it was being looked into.

    24th September: sent letter chasing for a response

    12th October: phoned chasing a response . They admitted they couldn't find my information for my first loan. Asked me to phone back a week later.

    20th October: phoned back to chase. An offer in the post to me.

    Received offer this morning for £1631.37. As they could not find my details for the first loan they had decided to give me the equivalent of an extra years interest on that plus the same again for the second loan as a goodwill gesture. They included at my request all the figures so I could check and see how it was calculated.

    I am delighted with the response and will be signing the form to say so and sending it back.

    A big thank to Martin and everyone on this forum. Couldn't have done it without ya! :T

  • my wife re-claimed her bank charges totalling £1080, (£1500ish with interest). natwest offered £1060, then the test case was announced. instead of challenging for the interest aswell, she accepted the offer just incase she ended up with nothing! it took about 3 weeks for the cheque to arrive. thanks martin!:j

    A painless process to be honest. Some of the charges were due to my own stupidity. I sent off the letter for the statements and a huge wad arrived! I made the list and sent if off with the letter from here and I received a wonderful phonecall from a lady in the Isle of Man who told me they had agreed to repay the full amount, but to please allow 7 days before paperwork came out as they were inundated. The letter arrived on the Wednesday , I posted it back on Thursday and the funds were back in my account on the Monday morning.

  • I recently helped my son over £1300 penalty bank charges over the last three years when he got into financiqal diffs. I thought that he should expect to get an offer of £6-700 as I had heard somewhere about a ruling that a charge of about £12 was reasonable for an unauthorised o/d or bounced cheque/ direct debit. They refunded him in full and he was delighted. Incidentally, he has some quite basic literacy problems, but is by no means stupid, which is why I did the paperwork for him, but he found the on-line video explanation informative and comprehensible. Also, I sent ML a thank you email, and he had the courtesy to send a personal reply - great stuff all round!
