    Amount claimed : £8,430.80
    Amount Won: £8,865.70

    Had to go through court but won as defense was thrown out. No need to attend as judge made decision in chambers after I questioned one of their letters that was ambiguous. Barclays ignored and so never had the letter clarified and lost out on getting in a revised defense.
    That was 3 weeks ago so now chasing for payment. Today start process of a Stautory Demand on the bank which means they will be forced to respond/pay in 14 days or I will have them declared bankrupt. :rotfl: Watch this space for result.

    Me vs Barclaycard

    I turned up at court on Friday bright and early with my court bundles all done...
    Anyway BC didn`t actually turn up but sent a letter to the duty solicitor with a settlement letter for £417... Very sly though as it was dated the day before (13th Septmenber).
    I think they were obviously hoping I wouldn`t turn up then they would have won by default... anyway I was given the letter minutes before I had to go before the judge.
    I signed it and kept a copy for myself and also signed a discontinuance so I wouldn`t carry the case on.
    I showed the letter from BC to the judge and he said he had seen it and it is a binding contract (I presume I will get sent the judges comments through the post or something).
    Anyway when I got back to work I E-Mailed the litigation team based in London a letter from myself saying I would accept... I sent their letter with my signiture on it and also a copy of the discontinuance. I also faxed the lot accross to them so they would definately get it.
    Havn`t actually heard anything back but checked my BC account and it has been paid onto there (I owed £430 anyway and was going to use it to pay it off)
    So if you have a court case looming make sure you turn up as you might get the same result as me :)
    Thanks everyone who helped me and keep going guys... credit cards are not in the same stay as bank charges.
  • :j I finally got my cheque from tsb today I claimed for £2,518 and got £2,518 today I can just keep at the banks the first time they sent £750. and I sent it back to them on may 2007, sent more letters to them and said ok we will refund you all your money so off I go to spain with my money

    rbs were actually very punctual and polite when i phoned them. I started the claim in late march and had the money in my account by the start of september. They sent me a cheque cos my account with them was closed. I was relieved to get it because the court case was announced just when I was waiting for their final response. Turned out my claim was processed the day before the ruling came in to stop claims!:T

    I'm very pleased with my windfall so thanks to martin and team for the letters! :money:

  • Barclays bank came up trumps before the freeze pending the outcome of court proceedings. They need not have paid me, but they honoured my application.
    Halifax are the pits yet again you have let me down they are holding out. But I moved my morgage and loan from Halifax so who has lost out in the long run? Took my business to companies who care about their customers. Thank you Barclays Halifax you need a reshuffle and get your act together get back to the grass roots - customers come first!!!!.

  • I first saw on gmtv that martin was telling people to reclaim their charges,My first thought was,but were normal people,we cant take on a bank worth billions!!! how wrong i was! After years of struggling with 3 children, and bills,etc, well life! I thought what have i got to lose!! I wrote a letter to lloyds tsb,a week later they replyed,,No Way Not getting a penny! they didnt think ther charges were unlawful,my husband said give up,your not going to get a penny!! I then went to the ombudsman,it was only a letter,they took the case on ,,We won and got 4.795 back!!! well worth the cost of two stamps.. THANKYOU MARTIN.:A

    I simply read the article and followed the instructions. They were a little slow but luckily the refund on our joint account was only authorised for payment by Smile the day before the OFT put the mockers on it. They were perfectly polite and helpful all the way through the process and although I set up a new current account with another bank in case Smile closed mine, they did no such thing. Thanks Martin!:money:

    My wife is trying to do the same - we reckon the Woolwich (now Barclays) owe her over £3k (she was charged anything up to £30 for having insufficient funds for direct debits, one one occasion 5 charges in one day). Barclays took over 60 days to send a list of charges and didn't bother replying to the claim letter, so in fact the OFT have really messed it up for us - however I can't see them ruling that £30 is a fair charge so hopefully it'll be sorted soon and she can get her money back - they fleeced her out of over 2 months salary with those charges!
  • HBOS current account - claimed £6845, received £6800 after 2 letters and then a phone call asking them if they wanted me to file claim online through MCOL.

    Bank of Scotland Credit Card - claimed £749, received £749 - had to file claim online with MCOL

    Morgan Stanley - claimed £400, received £400 - received after 2 letters sent to them

    Barclaycard - claimed £264, received £96 - wish I had pursued it further but it was my first one that I tried.

    Capital One - claimed £67, received £59 - only took me 1 letter to them.

    Still outstanding - Smile current account for £384.50

    Total received - £8104 :j
  • Barclaycard paid £284 today, letter came out of the blue and completely unexpectedly!!!
