  • Received a letter today from the ombudsman after following martins advice .They have been very helpful and kept me informed over the past month.They have taken the pressure off and the Halifax have finally decided to pay my charges back £1096.00, although the Halifax have stated to the ombudsman that their charges are not unfair or unlawful.

    My dad was charged £2,900 altogether in charges and the bank settled out of court>
    Absolutely fantastic
    Would recommend everybody to do claim THEIR money back!!

    Downloaded statements off the internet. Sent them along with covering letter on the 4th June. And toay I have been offered the full amount which I asked for and was entitled to.

    I have sent the acceptance form off and now await the funds to go into my account.

  • Bank: Halifax
    Amount Reclaimed: £196 + interest = 239.55
    Amount They Paid: £269.55 including interest and court fee

    The Story:

    1st June 2007 - Using MSE letter template contacted Halifax asking for money back in full + interest.

    7th June 2007 - Received response stating that charges where applied correctly and i was owed nothing.

    11th June 2007 - Again using template letter wrote back threatening court action if i did not get money in full within 14 days

    2 July 2007 - Had not received reply and i had gone slightly longer than 14 day, so i went straight onto moneycliam and within five minutes i had started the court process.

    8th July 2007 - Halifax served with Court summons

    11th July - Received letter dated the 5th offering £98 as a goodwill gesture!

    On the 5th the £98 had been paid in before i had even received the letter not giving me time to respond!

    I wrote back accepting the £98 as part payment and pointed out that because they did not respond within 14 days i had started proceedings, therefore as i had payed court fees i was now going to pursue that as well as the other owed. I stated i would not accept anything less than the full amount.

    Ironicly the same day i received the letter offering £98 they acknowledged the court summons...something tells me they do not communicate with one and other!

    23rd July - Received a letter stating that it would not be cost effective for the bank to go to court even if they did win as they would not be able to claim back any solicitors expenses etc, as it would almost certainly go down the small claims route.

    They payed the remaining monies (£171.55) including interest and court fees on the agreement that on receipt of money i would pull the court proceedings!


    My Message to all is DON'T GIVE UP AND PUSH EM TILL THEY FALL!!!

    Followed Martin's format (almost)
    letter 20/4 - saying I wanted my charges or I'll take you to court
    letter 22/5 - from Lloyds 750 final offer, replied saying thanks but nothanks
    started court proceedings, they acknowledged and then defended.
    19/6 transferred to local court
    9/7 Lloyds letter - we will defend, couple of days later offer letter (dated same day as defend letter!) sent off my acceptance
    26/7 money in account - over £5000

    Thanks to all on this site, and to everyone who is still battling keep on going! Went through some low spells along the way but reading the sucess stories kept me going!!!!!!!!!!

    Started the process in march 2007 following martins instruction exactly..,
    Received standard reply to my second letter saying they were fair and a fee for services blah blah blah!
    Next step threatened court action - had no reply
    started court action through MCOL
    LLoyds put in a defence
    Got court date 17th August 2007
    end of june received letter from lloyds solicitorssaying they would like to start settlement negotiations...!!!
    i replied stating i claimed the full amount plus interest up to court date
    july 24th money paid into account without any negotiation..

    :beer: well worth the effort!

  • Call today....from S,M&C....saying that they were re-paying me my charges. call about two hours later saying that the money was in my account.... it was! quick fax to the court...(I was due to go on Monday)...the job is a good one.

    It's been a long road... lot's of paper but worth it in the end and I was expecting to go to court.


    Nice surprise to a wet Thursday

    Went through all the initial letters with the usual responce, so took them to court and with 6 days to go of the 28 days allowed the full amount was paid into my wifes account. Thanks Martin.

    Don't forget you can do this with credit card companies too!

    Barclaycard - £120 refunded to my bank account, <SNORT>that's the full amount I requested. result!. The Barclaycard account was closed by me 2 years ago

    now I'm about to chase Barclays bank for the £1300 + interest I requested....
    This year, I will mainly be kicking some serious money saving butt! :D
