i first wrote to my bank in late feb. i followed all the steps on this site. i eventually got to the stage of getting my firrst court date, being, 14th aug in Cardiff.around the 6th of july i received a settelment offer which i accepted and the money went into my account on the 16th.
However. i had an overdraft of £390 which as i expected would be taken from the total.but i didnt expect the bank to take(steal) £643 on the 17th, which i owed in arrears on my lloyds loan. i called the collections dept and accused them of theft as they had taken money from my account without my authorisation or knowledge. i also explained that i simply couldnt afford to make such a large payment and felt that it should be my decision to make any such payment. the only link between my loan and account, is that they are under the same name. i was already making token payments on the loan and the bank are in the process of legal action to destroy my credit rating.
the collections dept agreed immediatly to refund to money, but it would take 3-5 days (it seems they are unable to do an instant cash transfer from their own funds). the money never turned up so i rang again and they told me to go to my branch and get them to call collections, and that they would authorise an in branch cash paymayment.
i went to my branch yesterday and it took an hour but i got my £643 back.

:j Well went through the process as directed by martin :money: opened parachute account then sent the letter's off one by one,didn't get much correspondance from the bank at all.They firstly refused me so threatened court,went online did a claim,waited 2wks last day they acknowledged so waited another 2wks and about 2 day's before end if the time,got an offer :T £6,006.97 in respect of charge's and £1,587.90 in respect of approx interest,the halifax does not consider i'm entitled to the £2,202.60!,well even though thats great I decide to write and ask for £9,000 and court cost's oh and also want my bank account reinstated thank you very much.
No reply!,so feeling
bit worried I might have blown it I decide to ring the customer relation's manager.
All I can say been firm & polite didn't work,he was quite rude and when I asked if he'd go to court over 2grand he said it had gone past haggling,rude man!,obviously he knew something I didn't!,and now we know what!,the bank's are going to court!.
So he wouldn't budge so I decided to accept the offer which was paid into a savings account that day,but didn't get my account back!,:mad: he said wasn't the fact i'm claiming it was because my account was overdrawn!,I said yes it is it's more bank charge's and you closed it not me!,anyway ive got my money and will write to the banking ombudsman about my bank account and halifax attitude.

I sent my first letter the end of May asking for the charges back, they sent me a letter saying they would look into it but it would take between 4 to 8 weeks, i gave them a ring and they told me i would hear no later than the 17th July.On the 17th July i had an offer of £2005.00 which i put aside as i didnt know whether to accept or not until yesterday when i heard about the freeze on all claims.I gave Barclays a ring and found out that if i accept the offer it will be paid into my account but if i decline it will be put on hold, so i decided to accept the offer and it will be going towards my new kitchen:j

After getting statements I requested in mid April the above amount this excluded interest as i thought this would be pushing my luck a little, Ithen received a letter of acknowledgement explaining it would be dealt with in the next 7-8 weeks this was 1/6/07, as the 8 weeks was up last week I rang the number on the letter and was told as it was a big claim it will be the week commencing 1/8/07 when i received an offer. However I then received my offer on friday 27/7/07 for £4,800 which I have accepted and am waiting for this to be credited to my account. so go for it if your thinking about it.

hi,
just a quick note to tell you all that, 8 weeks ago i started the process for my wife and my boss also sent a letter of to the royal bank of scotland.
it was with great delight that on friday 27th july my wife got a letter from rbs offering the full amount claimed which was £760!! my boss also got what he claimed for which was £543. success!!!!!!
so just hang in there.

I picked up the campaign from RADIO 2 whilst at work. I then encouraged my partner to do her account.(her being a secretary and all) She spent all night doing charge hi-lights.Sent it of.Got denial.Heard on the radio about bank court success story.Heard martin lewis on radio again saying "carry on".Encouraged her again to proceed,send it back.She did so and added interest for effect.Next she's recieved a letter not admitting liability,but here's £750 quid as a good will gesture.(minus interest i noticed)Many thanks to Martin Lewis and Team. You really have helped our holiday.

After two failed attempts to reclaim bank charges fom HBSC,becaue of
A A Large overdraft
B The thought of the bank closing my current account
on the third attempt i sent of my fiest letter requesting copy statments over the past 6 years,these duely arrived in bits and pieces over the next 4/6 weeks
I then requested repayment of £928 in charges,after four weeks having heard nothing i sent a second letter claiming £1002 .24 original amount plus interest as in the template letter.
On friday 28th July the bank wrote to me offering a settlement fee of £806:40
in full and final settlement,which i have accepted.

hi first time for me and its good news halifax paied up 1275 it was really easy sent the letters off each step and in the end they paied :j0

On the 23rd HBOS sent me a letter of offer of settlement of around half my claim without interest (£658) which I ignored as I was already a fair way through the court process. This was credited to my account the same day...
On the 25th they settled in full!!!
Am expecting a letter asking for the original settlement back but with less than 24 hours before the test case announcement I had managed to squeeze £2223.54 from the dirty money grabbing bankers!!!
Unfortunately I had no joy with HSBC, they successfully stalled until the 26th...0 -
Thank you so much for all your help:j :beer: :T . Claimed £1060 from Lloyds TSB last March and after their standard rejections I took them to court, which they defended. When I sent the Allocation Questionaire back Lloyds decided to pay the full amount and it took about a week for them to actually deposit the money in my account. It took about 3 and a half months in total. THANK YOU MARTIN, YOU ARE GREAT, I WOULD NEVER HAVE DONE THIS ON MY OWN.
Good luck to everybody trying to claim. Don't give up, even if things are left on hold for a while with the 'test case' :eek:0
