Sorry for bad writing. Just back from Minorca ( booked through Cosmos saved £475.00 with Tesco deals)and a bit tired.
Anyway Martin Lewis can do no wrong in my eyes and everyone should all continue with claims. I think the banks are just trying to put people off!!

I wrote to Barclays bank in May asking for £975 in charges and they wrote back to me saying they'd respond by 13/7/07. I fully intended to send a letter by my 2 week deadline telling them I'd take them to court, however during that time my Mum was admitted to hospital with a cerebral aneurysm, then DP went into hospital for an operation and I totally forgot about it. Last week I got a letter offering me £770 and as that then works out that I would have paid about £4 per charge I've decided to accept rather than take them to court for the full amount.

I'm getting married in 9 weeks so that will do very nicely thank you. Mind you - I've not got the money in my hand yet so we'll wait and see before we get too excited!!

Sorry - in my jubilation I forgot that the actual point of my thread was to thank Martin et al for the template letters and all the support through the process. I've been talking about all this at work and several people are now in the process of robbing the banks legally!! I've recommended MSE to everybody I know.
  • I just wanted to let you know of my success. I spent 4 hours detailing my charges for the period I banked with First Direct. I sent a letter on the Monday morning requesting approx £3500 including interest for the 5 years I was with them. On the Friday I got in from work to an offer letter. They offered me £2250. Not bad for a few hours work and especially as you pay your charges so its money that has gone. Obviously they do not agree that it was an overcharge, but that they are aware of the costs involved in pursuing this. Not that I'm grumbling. This process took less than a week, and I am now just waiting for my payment. Thanks Martin. I used your template letters and my outcome was so much better than I expected.
  • Sent first template letter to RBS mid May and had a couple of courteous letters saying they were looking into my claim. Last Friday (20th July) I had a letter from the bank saying that although they believe their charges were fair and that I had agreed to them when I opened the account, they would offer me £619 paid directly to my account without accepting liability. My total claim had been for £649! I posted slip back accepting offer the same day, and the money hit my account on Tuesday (24th July). What a result!!! :j

HOWEVER... my husband and I are also going through this with the Nationwide, who after investigation have flatly refused to pay anything. So I am going down the small claims route, was waiting to have £80 in my debit card account so I could file (thanks again RBS!) and have just logged on to do this and seen that all claims are now on hold following the OFT announcement. So fingers crossed for that...

  • A friend informed me that the OFT and the Banks are going to court over the charges. I had just had a letter from my bank on Saturday 21st July offering me money as a 'goodwill gesture' for £996 and £172 on two accounts I was claiming a refund for. As this money was approx the amount of the initial claim (less interest) I did not hesitate to send my letters back to them to accept (don't know why 2 pre/paid envelopes had different addresses and one was 1st class and the other 2nd class!)

As you can imagine when I heard the news of the 'freeze' I checked on the internet and found to my amazment that they had paid the lowest amount into my bank on the Tuesday (must have been the 1st class one!) my worry was then, that I would not have the larger amount paid in, but my partner said as they had offered the money and I had accepted it they must honour it. Checked at the end of Friday and found that the money had been paid in. Great.

I sent my initial letter off in April, got a shedload of bank statements to sift through, then sent a letter with the breakdown of charges (including interest) and by the end of July I have got my money. Unlike my partner who used an online solicitor who took forever to keep him informed and wanted to charge him nearly £1k to claim £5 back from his bank. He got his money back ages ago by accepting the banks offer and they still haven't asked for his fee, even though they hardly did any work for him! Hope they forget!

My bank is the Royal Bank of Scotland and his was the Halifax.

Hope all of you that are still waiting are successful and the OFT and the courts rule in everyones favour and set a more realistic charge for the penalties for unauthorised borrowing. Charging £28 for going £5 over when it was a cheque to the bank to reclaim my bank charges was ludicrous, when they had taken 2 months to clear the cheque, seemed like they were waiting for my account to get really low.

    Bank : Abbey
    Amount Claimed: £4828.00
    Initial Payment : £805.00
    Final Payment : £4706.05

Just like to say a thank you to those that gave me support during the past 8 months that it's taken to put our claim together. It's been a ballache to say the least!!

We were a little worried yesterday when we heard about the 'freeze' on bank charge claims, that was at 11.00am! Got home at lunch time to a letter from Abbey saying that they're refunding us £4706.05!!! Brilliant, more than the initial claim, there's 2 lots of interest on the breakdown, and they're not paying our claim for expenses, but even so it's still £300 more than we thought we'd get!!:T :T :T

    Thanks again!
