Started claim back in Febuary after reading through this site, I went through M.C.O.L. then got transfered to my local court, got a letter from banks solicitors 2 weeks ago saying they intended to defend my claim, then i opened next letter that arrived in the same post with an offer i couldnt believe it. I recieved my allocation questionaire after i signed to accept offer so i rang banks solicitors yesterday as I wasnt getting through to the andover recovery centre, and hey presto checked my balance this morning and there it was. Big thank you to Martin and all who have left feedback to all of my queries and concerns. :j :j :j0 -

Again, fought every step of the way, submitted defences etc. Threatened to close account if we claim again.
Abbey National - Claimed - £450.00 + Default removal
Received - £0.00 so far + Default not removed. It seems we are actually going to court on 15th August. I've just sent in my court bundle in which I asked for compensation aswell. Can't wait for 15th, Bring it on Abbey!!!!

The story:After sending 3 letters and making a phone call to them they said they dont pay the intrest and will only pay 1176.00 but my 100.00 overdraft had gone up to 353.24 WITH CHARGES SO THEY WOULD ONLY PAY 822.76 WHICH I ACCEPTED BUT I`M NOW CONSIDERING CLAIMING THE 253.24 CHARGES. I was due for my hearing on the 2nd August. I received my offer on the 23rd July. I faxed my acceptance to the solicitors yesterday morning. The money was in my account yesterday evening.
I have incurred charges on my account while waiting for this claim, so am thinking of putting in another one.

The story: Had to go ALL the way with this claim. Issued online court proceedings (the link on this wonderful website) cost me £80.
Recieved acknowledgment from the courts.
2 weeks later received letter saying HSBC were to defend ALL the charges.
2 weeks later got a letter from the courts basically saying due to the fact so many people were taking banks to court for unfair charges, the court were considering throwing out the defence (the bank) due to it wasting the courts time, unless the bank could produce evidence of ALL successful claims and amounts it (HSBC) had been successful in defending.
4 days later a letter offer from HSBC!
My husband has just won simular amount from LLOYDS almost identical circumstances.
DO NOT GIVE UP!! DO GET BE SCARED OR FRIGHTENED. DO NOT BOW DOWN to legal letters. You ARE entitled to this money. Am not sure for how long it will continue, but for now, you CAN laim 6 years charges back, and for all the huffing and puffing and legal letters from the banks - THEY WILL PAY YOU!! Good luck! x0 -

Halifax wrote to me last week and offered £631.50 (exactly 50%). I rang and asked if this was negotiable and was told by an extremely helpful person that they would refuse this offer and I would hopefully get a better offer.
Rang back today (1 week later) and enquired if there was a better offer for me and was told by another extremely helpful operator that they would ask my case manager to ring me. Sure enough he rang me 10 minutes later and, once again, was friendly, helpful and human. He offered a settlement of £947.50 (exactly 75%) which I have accepted (was hoping for between £800 - £1000).
I am amazed that I have managed to reclaim any of these charges and am extremely grateful to Martin and everyone who is a member on this site for all their help and enthusiasm.

12/4/07 - Telephoned to request last 6 years' bank statements, told would take up to 40 days to arrive.
4/6/07 - Telephoned again after no statements received yet! :rolleyes:
5/6/07 - Received statements, carefully totalled up all default charges and wrote out on paper to send to bank (kept original statements). Wrote date of charge, type of charge, amount and interest of each individual one (used interest calculator on this site). Used template letter on this site asking for response within 14 days. Sent letter to Customer Relations address by recorded delivery 5/6/07.
12/6/07 - Received reply from Customer Relations explaining that complaint is being investigated. A solution is hoped for within 4 weeks, or an update on progress will be sent within 8 weeks.
4/7/07 - Received 2nd letter from Customer Relations apologising for the delay in response. A solution is hoped for asap and will contact again by end of July!
5/7/07 - I sent a letter (used court threat template letter) demanding a pay-out otherwise I would take to court. Sent by recorded delivery. Gave them 14 days to respond.
20/7/07 - Received letter explaining that they disagree with my opinion, but are willing to offer £765 as a gesture of goodwill in full and final settlement of my claim. They admit no liability. Amount would be credited into my account in 14-21 days after acceptance slip received.
23/07/07 - Telephoned Customer Relations and asked if there was any way they could offer more instead of me going to court! They refused to negotiate and said the charges are 'yet to be illegal'. Oh well, I tried! :rolleyes:
24/7/07 - Telephoned Customer Relations again to see if their offer of £765 could be accepted over the phone and wired into my account faster. They said it had to be done by mail due to the amount of claims going on etc.
24/7/07 - I sent back acceptance slip for pay-out of £765 by recorded delivery (just in case!). After investigation of possible online claim (MCOL link on this site) I decided I couldn't even find the £120 fee to pursue my full claim of £1265.
Just waiting for the money to appear in my account now in next couple of weeks! I decided it's money I thought was gone forever and means a lot to me despite being £500 short of the full claim with interest. I'm sure if I'd had the £120 MCOL fee I could have got the lot, but I'm still happy.

Took quite a while to get there as they really dragged their heels - but after threatening court action we were made an offer of about £2,500. When we said we'd carry on with proceedings they upped the offer to £4,500 but said they couldn't go any higher - we counter offered at £4,750 and agreed that amount, which was credited to our account within 14 days. Used the money to pay off two credit cards (Martin would be impressed!) Still a way to go but well on the road to becoming debt free now and have turned things around so bank charges are a rare oversight, not a daily occurrence!

taken just over three months from start to finish, got sent the usual "sorry but not able to proceed as charges are fair" letter so i wrote to the financial ombudsman following matins guide and a & l settled my claim in fulll as did not want a full investigation from FOS. My adise to everyone is CARRY ON REGARDLESS OF WHAT THE BANKS SAY. you will win
