Started my claim in March and received statements not problem, offer letter received 1st June minus interest which I accepted and sent straight back, had a few problems because account with credit management who kept telling me they would send a cheque I finally spoke to someone who arranged for me to collect the majority of the money from my account last week but as they had continued to add interest to my overdraft which was frozen in September I still have £126 left to be sent out by cheque, should receive it at the beginning of August.
Just shows that if you ring then often enough it can be done, result my overdraft is now paid and I'm about to tackle Sainsburys credit card and my partners Woolwich account :j

Advice - Just be polite & professional at all times. Always send letters Recorded 1st Class post, make sure all the details are correct & do not ring them as formal letters are much better then a brief 'unrecorded' conversation with a bank employee.
Remember they are a business, they saw an opportunity, 'bent' the rules to suit & became VERY GREEDY. Plus if we were better at looking after our own finances we wouldn't have been charged in the first place. But it does show us not to trust any of the banks etc to do us favours in the future!
The extra income Banks had over the last 20 -25 years is possibly £££billions and even if they paid back everyone for this last 6 years i dont think it would worry them in the slightest. They possibly had an idea that this would happen one day anyhow. (It would be interesting if there are any retired bank staff on this forum, who had been in meetings where 'default charges' was an discussed subject by the banks.
Thank you to Martin Lewis, and everyone who helped me reclaim over £7000 regards default charges. (When i think of £7000 over 6yrs, its about £100 per month!! I think i need to improve my how i look after my personal finances!:beer:

Amount received: £2400
Copied all statements from HSBC website. Sent first letter (asking for charges and interest) and got a prompt reply saying they would investigate.
Waited 2 weeks and sent another letter giving them a further 2 weeks to finish investigating.
After no response, sent a third letter telling them I'd go to court if they didn't reply in another 2 weeks.
No surprises, they didn't reply. Took them to court on the moneyclaim.gov.uk site using Martin's template.
Got a response within 3 working days offering to refund all charges but without interest. That letter arrived today and I intent to accept.

Sent for a list of my chrages, which came within the 40 days. The list was a bit confusing to understand, and from my understanding I calculated that I was owed £2100 but recieved £1500 - which I am more than happy about!:T
I then sent the 2nd letter (from Martians templates) twice as I had no response and a separate letter to the complaints dept to which i heard nothing. Then yesterday I checked my bank account online and the charges had been refunded! I've still as yet recieved no correspondence from the bank!

Has been a bit drawn out in length of time it has actually taken, but only required sending the first two form letters from this site. So pleased to have actually got a result without having a long drawn out process.

The story: Wrote to Natwest in April asking for a list of my charges, within two weeks I'd received a packet with every statement ever. I added them all up and came to £526, I thought I'd ask for interest as well, so I wrote them another letter. I received a letter a couple of weeks later saying it'd take "six to seven weeks" to receive another. On Saturday I got a letter saying they'd pay back all £526 into my account! Result.0 -
Right, sent off for statements on 7th April, got letter back saying that they would be arriving in batches soon. And so they did. Calculated that HSBC owed £2672.50 to me. Sent off letter containing charges list, got a confirmation letter in May saying that they were looking into it. Just received letter today saying that, without prejudice, they are paying into my account, £2239.75 within 14 days.:T0

Amount Gained: 1677 which is 90% of claim excluding interest and court costs.
The Story: They sent the statements through within one week and replird to first request with a "looking it" letter. Sent second request and no reply within 14 days. Issued court proceedings which they acknowledged almost straight away. They sent through the offer letter and also defended court claim. We accepted the offer as didn't want it dragging on too long and split the money!! Hee Hee!!

The Story: Requested Bank statements in April ( still not receieved them! ) no reply, luckily had most of my bank statements for the last 5 years anyway ( new I kept clutter for a good reason!) First request was ignored as was the second request. Complained to the information commissioner which is a complete waste of time as I still have not recieved my bank statements as clearly there is nothing te comissioner can do about it. Requested they look into charges over the telepone within 5 days they sent me a letter saying I was entitled to nothing and the charges were legal. She automatically sent through a second request for me. 8 weeks later I have now had a response offering £158.00 (50% of claim less interest). I ran them and advised them this was unacceptable and they offered me £237.00. Apparently they are only authorised to negotiate up to 75% of the claim excluding interest and court charges. Said it wasn't good enough and she couldn't do anymore. Rang them back an hour later and she still couldn't do anymore so accepted the offer. However I will now change my bank as I have all of my accounts with them and my mortgage and credit cards and even my daughters savings account so there loss is a very loyal customer. What angers me more is that they are now advertising £100 free to new account!! Disgusting!!
