    The story:

    Sent my first letter on 02/05/07 requesting a list of all charges made against me. It took them 43 days...but I let them off!

    I then sent a letter requesting my charges as i wanted them back on 14/06/07. I got the usual fobbing off letter "it wouldn't be fair on other customers...blah blah blah... stick to T+Cs...blah blah blah". That letter came to me in a week so i didn't hold a gruge about getting my charges late.

    I sent a letter threatening court action on 22/06/07 and heard absolutely nothing! So on 05/07/07 I started proceedings with MCOL. Nationwide acknowledged on 12/07/08 and had until 08/08/07.

    I got home from uni today and had a letter stated that they had refunded the money into my account and if i breach the T+C's they will have no choice but to give me 30 days notice and close my account.

    However, the money isn't in my account so i rang them and they said it would be there in 3-5 working days. So, I'll keep you posted!

    I never would have done this if it wasn't for Martin and everybody else's encouragement! This is money I never knew I had! thankyou so much everybody :money: and everybody else KEEP GOING! IT'S YOUR MONEY!

    hello,
    well decided to take on my bank 7 weeks ago, not expecting anything.sent the first letter template.i did actually go through my statements myself online and wrote down every charge and the date from the last 5 years.had letter back week later saying they would be looking into it for me.7 weeks later [this morning] got letter offering £820.25 , am going to accept.cant believe how easy it was ,really chuffed.

    Amount claimed: account 1. 2200.00 incl interest and fee's.
    Amount won: 2200.00.

    Requested statements Nov 06, filed MCOL April, defended, settlement letter 17/5, payed within 4 days.

    Amount Claimed: Account 2: 2600.00 incl interest and fee's.
    Amount won: 2600.00.

    Requested statements Nov 06, filed MCOL April 07,defended, transfered to local court, date given 3/8, bundle had to be with court on 18/6, Lloyds failed to comply, extended to 11/7, Lloyds failed to comply, the court ordered judgement and awarded us and Lloyds to pay forthwith, dated the 12/7, money received today in bank account!!!!!!!!!!!!!!!!!!!!!!!!!

    £4700.00 better off, long awaited!!! and Lloyds played the game all the way, just be difficult.

    I arrived home from work, and hidden amongst some junk mail which I'd received was my letter from HSBC! :T

    I nearly chucked it out!!!!:eek: :eek: :eek:

    In it was an offer for over £1900 ( my claim was for £2100 without interest) :beer: :j :T :rotfl:

    So I will hot foot it to the post office tomorrow and send back the acceptance letter and wait for the money to roll in to my account :j :j

    I am so pleased!!! So that's a total of over £3600 claimed back!!!!

    Anyone wondering whether to wait the 8 weeks or go down the court route, my advice would be to wait the 8 weeks.... far less stressful, only costs the amount of a couple of letters sent recorded delivery, and a couple of months down the line a lovely chunk of money!!!!

    Thanks for everyone's support!!! Especially Martin for all the advice :money: and to all on the HSBC forum who have kept me sane(ish!)

    Amount Reclaimed £1124.14 inc. interest + £120.00 court fees
    Amount paid back £1264.64 (£20 more, oh well.)

    Started claim proceedings with letter requesting statements on
    06th Feb.'07
    Requested charges back 21st March. No reply.
    Court action threatened 16th April. No reply.
    Court process begins with HMCS Money Claim Online 02nd May.
    Suprise,Suprise Lloyds are defending.
    Notice of Transfer of Proceedings recieved 06th June.
    Letter recieved from courts giving us our hearing date as 07th Aug.
    Lloyds solicitors SC&M request futher information & in a round about
    way to enter into settlement negotiations. Reply to letter
    reminding them that all the information requested has been sent to
    there clients on two previous occasions, & suprised that they have not
    been forwarded on.
    Send letter to SC&M solicitors to request/enter into an out of court settlement for
    £1244.00. on 12th July.
    No reply, so contacted Lloyds by phone on 23rd July about settlement,
    but informed person/department i needed was only available by post.
    Then contacted SC&M about similar, but they told me it's taking about
    2-3 weeks to process paperwork, so i informed them that today (24th
    July) was the final day for providing evidence for court. ....Nothing.
    BUT just by off chance i happened to check my bank account on-line & low and behold there was a payment today, 24th, for £1264.64.
    Ha, Ha, I WON.

    I wrote to them twice, after 6 years of over charging. They wrote back once saying they were looking into it, but a month passed and no reply, so i followed your advice for the small calims court. They have written to me twice, offering £550 and £954 - both letters are the same, and both are dated today. All i have to do is sign them both and send back - does that mean i am legally entitled to both, as they have written offering it to me, or will they realise their mistake and only honour one letter??

    After going right to the court deadline the Halifax offered me £506.85, which includes both interest and court fees. This is the third bank account claim in our household so as a total of ALL three accounts we have claimed back a staggering £3,774.57 So if you were thinking about claiming.

    Got statements, sent letter asking for money, they refused, threatened court, they offered 30%, went to court, SETTLED!!!!!

    Amazing, what can i say....

    Also i have got back £60 from natwest and £60 from Alliance + Leicester (small amounts, but still, its the principle)

    Next i am going for:

    Cahoot: £318.37
    Nationwide: £269.23 (No shareholders, but still SCREW US OVER)
    Halifax: £1145.15

    I will let you know how i get on with the last one!!!
