  • I submitted a claim to Easyjet at the end of September sent by signed for post. It was delivered I have still not had any acknowledgment or response. How long should I wait before taking further steps?

    Hi, I sent a claim to Easyjet for a delayed flight recently. Although the replies from them have been surprisingly quick so far (within 24 hours every time on last 5 emails), they rejected the claim on the grounds that the delay was due to a surge in one of the engines which was deemed extrordinary and could not have been avoided. Does anyone know if this is a genuine extraodinary circ or I may still have a chance to fight further? Any advice is appreciated.

    I advise you to read the FAQs on page one, which will tell you that technical faults are generally not to be regarded as extraordinary but that you are likely to have to take them to court to get your compensation.

    Hi Vauban, thanks for the reply. I have indeed read all the FAQs and I am aware technical faults are GENERALLY not to be considered as extraordinary, but "generally" itself does mean exceptions existing and there is no clear guidance on what exceptions are hence my post for advice. I guess as you said I will have to take them to court now.

    OK, so you must have read the FAQs, would you mind telling me whether a surge in engine is definitely Easyjet's fault and warrants a claim or it's manufacturer related?

    Having read the FAQs does not mean you will be able to answer all your questions automatically. This is what we have this forum for.

    All I need is a bit of advice from anyone who has this sort of technical knowledge or has similar experience, not peope taking things for granted and questioning me if I have read the FAQs.

    Engine surge is a technical problem which is commonplace on the Airbus you flew on and as such is not extraordinary.

    Ok. No one can answer your question definitively because it depends fundamentally on the view of a particular judge on a particular day. You need to determine yourself whether you believe that the law means your circumstances qualify as extraordinary or not.

    Centipede has given you very good advice. Read the Huzar judgement (particularly para 27) and make your own call. The Wallentin judgement is good background reading too.

    If you find this too difficult, too dull or too much effort then think about instructing a NWNF solicitor.
