I think some would agree but if the matter does go to court, possibly miles from their base, they have to represent you plus hearings are being deferred due to lack of information from the defendant meaning a re-visit. Probably they are on a winner if the airline pay out before court but a loss leader if (particularly say for a 250€ claim) if they have to 'appear'.0 -
Hi there - newbie here! I was booked on a flight last night from Gatwick to Glasgow but it was cancelled. There were no flights available until today so we rebooked with BA. Would we have a case for compensation? If so is it best to send the template letter by rec delivery? Also can we claim the cost of the new flight from our insurance companies? Thanks in advance.
Update on this for you guys. I emailed easyjet using link on their website (sorry can't post the link as I'm a newbie) on 16/10/13 and I copied and pasted my letter that I had written from the template on this site. I received an email today saying my 500 euros (2 passengers at 250 each) will be transferred to my original payment method in 15-20 days. Result! :beer:0 -

Hi everyone, bit of advice please :beer:
I was due to fly back from Funchal to Gatwick 16/10/13 at 19:15. When we arrived at airport we was told our flight was delayed due to flooding that resulted in a large power cut at Gatwick south terminal earlier that day. We were all checked in and told to expect an update at 20:00, which then went to 21:00, 21:30 and so on.... Finally the outbound flight took off from Gatwick at around 21:30 instead of the original time of around 14:00. Flight finally arrived 00:25 at which point we were told w would be departing 30 mins later. They rushed us all through passport control then out onto the runway ready for us to get onto the plane, to then all be told there was not enough water on plane. We were ushered back inside then and not told anything, until the pilot finally had to come in around 02:30am to tell everyone that due to easyjet not providing certificates to Funchal airport to do with the water, the pilots and flight crew had run out of flying hours and the flight would be rescheduled for 16:00 the following day (17/10/13). I have sent the template letter off to them and awaiting a response, but just wanted to know what other think? Do I have a chance of compensation or could they put it down to the weather that caused the flooding earlier on in the day? Other flights managed to carry on taking off throughout the day, that were from the south terminal also. There was nobody to speak to at Funchal airport apart from the pilot that had to come in who was having a lot of abuse aimed at him, but I heard him say that the reason the outbound flight from Gatwick was delayed, was firstly due to the power cut, which then in turn made the first pilot run out of hours, and then they had to get another pilot in that can land in Funchal as apparently only certain pilots can land there.
Any help will be greatly appreciated

easyjet are claiming that the delayed flight on 11th October from Mykonos was due to a hard landing - is this classed as an extraordinary circumstance?

I was on this flight too and easyjet claim that it was a hard landing into Mykonos and therefore the plane had to be checked. I don't remember the weather being bad in Mykonos so if they say there was another reason behind the hard landing i.e. technical fault, pilots decision/error then would this still be classed as the extraordinary circumstance they are claiming?

Well I've never flown easyjet but I assume that landing is part and parcel of the service they offer. Maybe they are suggesting that the pilot wasn't in control of the aircraft so they can't be held responsible.
They really do seem to be taking the mickey!0
