I have made a claim. But I'm willing to bet the response is going to be that it is extraordinary circumstances, due to safety concerns....

  • Family of 4 were on flight EZY 8610 on 20/02/2020 at 21:20 from AGP to LGW. We were delayed nearly 4 hours due to the French air control strike. I genuinely did not think we could claim but submitted our details to Bott and co. They have written today saying we do have a claim, of €400 each  however I mistakenly believed their fee was 20% not the £162 per person they are asking for!!
I have had previous success, taking Thomson’s to small claims court but that was a mechanical fault with the plane, not a strike.
Wondering how best now to proceed. Had anyone had any success with successful claims against French air strikes? Should I try Resolver first or try myself and if no joy go back to Bott and Co?
    thanks in advance!

    EUClaim shows

An analysis of the data for this flight shows that an extraordinary circumstance was the cause of the delay.

Unfortunately you are not entitled to compensation.

An extraordinary circumstance is a situation which the airline has no control over and cannot be held responsible for, for example, a strike by air traffic control staff, bad weather or a terrorist attack.

There have been a number of posts where Bott have initially stated compensation due to then change their mind. If the delay was due to French ATC then there is no compensation due.

Botts "may be entitled" appears to be based purely on the delay, I would expect them to confirm 'no' once they see the reason for the delay

  • If it's down to ATC there is no claim for EU261 compensation. Bott say yes to nearly everything, and aren't as reliable as EU claim.

Hi. We had our lanzarote to gatwick flight cancelled, apparently due to the sandstorm. The flight was halfway to lanzarote then diverted back. But why was it only easyjet that cancelled. Can i claim, well i will claim, but i expect it to be turned down. Also i could not get another flight until 6 days later, which we had to accept as we were told all available seats were being taken at a rapid rate. This was because we couldnt get any help until 5 hours after the cancellation. Later that night  around 2am i discovered that there was earlier flights to liverpool or manchester, that  we were not offered. We were told that they only check flights to original destination. And if we wanted to change then we could at my expense and they wouldnt reimburse for travel from the other airports. I have lost business and incurred costs for various things that are not covered by easy jet. Also they put us up in a very poor  all inclusive hotel, which i complained about, and told them we refused to eat there so would be claiming food expenses. Their response was they had never had a complaint before so because of that they were closing the case. Sorry, i know the last part of post has nothing to do with the flight but felt it needed airing.
    Thanks

Put your cancelled flight details in two online flight checkers euclaim and bottonline and see what they say about compensation. Easyjet has a duty to re-route you 6 days is totally unacceptable. You could have booked flights yourself and Easyjet would have had to pay for them. Regarding the food I doubt whether you will get your money back, they provided a hotel and food the fact you didn't like the food is not their fault. You can always claim and see what they say.

If you are due compensation it will be €400 per person. Any business loss would have to be claimed through insurance if you had any.

Dont think insurance will cover business loss, but will check.
Whats the general opinion of why it was only easyjet that decided not to land. The sandstorm had been there all day and our flight was around 7.40pm so why get half way. The airport did not close as it wasn't that bad at lanzarote then. In fact when i got the message on the app it said flight cancelled due to Las Palmas airport closure, i was at arrecife. If its unsafe, then fair enough, but it seems  from news reports it was gran canaria and tenerife that had airports closed. And from what i could see at arrivals info screen  most flights weren't even delayed

  • Check the 2 flight checkers I mentioned, euclaim are more realistic
