    What is the best way to claim compensation for both?

    Do you have evidence that there were alternative flights?

    If not, you may be due fixed-rate compensation for the EasyJet cancellation under UK261, but I don't think you are due anything other than a full refund for the holiday

    Surely, in the context of notification from EasyJet of two flight cancellations, entitlement to UK261 compensation for those is dependent solely on whether or not the underlying reasons were extraordinary circumstances?  There's no obligation on the passenger to locate alternative flights, or to prove that there weren't any, when EasyJet advised that there were no suitable alternatives....

    No, but if there's alternative flights, it opens up possibilities under the Package Travel Regulations, which I know is off topic for a EU261 claim but also worth bearing in mind.

    No, but if there's alternative flights, it opens up possibilities under the Package Travel Regulations, which I know is off topic for a EU261 claim but also worth bearing in mind.
    I'm still not following - when EasyJet Holidays have committed to a full refund for the package that was cancelled, and the traveller also has the potential to claim UK261 compensation from the airline (if not extraordinary circumstances), what additional remedies could be available under the PTRs?
  • We had our return flights from Alicante cancelled due to a Runway blockage on the 28/06/24 at Gatwick. This resulted in a closure of 50 minutes. Easyjet were unable to fly us out from Murcia until the 30/06/24 in the evening. 
    They apparently use tactical cancellation’s, so in our, and many other people’s cases they cancel the first “wave” of flights the following day.
    This is also what they have done today due to the weather yesterday(19 flights this morning).
    They then say it was out of their control to avoid compensation. Very shabby way to treat customers !!

    Easyjet can not be held responsible for the British Airways B777 incident that closed the runway at Gatwick for 55 minutes. This caused a large number of diversions and cancellations.  The Emirates flight even ended up in Brussels. 

    European airspace has also be plagued with ATC issues recently, much down to weather issues over Europe and flow restrictions being put in place and airlines told to reduce flights.

    All above is not ideal and I am sorry that your return travels were disrupted.  Compensation may not be payable if outside of the control of the airline, and I think these above reasons are.  Not 'shabby', just the way it is.  Sometimes things happen and you can't gain £££ from others.

    Hi All,
    My Daughter had her flight from Hamburg cancelled by EJ and the only alternative flight for her to get back for work was out of Munich the next morning.F
    Flight Number: 8636, Flight Date: 21/07/2024.
    She put a claim in for the additional expense but EJ are rejecting it for reasons outside their control (see below).

    "We always review claims fairly and in keeping with EU/UK regulation.  When a flight is cancelled, all customers are entitled to switch to a new flight for free, request a full refund, or a voucher for future travel. However, as your flight needed to be cancelled for reasons outside of our control, unfortunately we’re unable to offer you compensation as well.
    To further explain what happened on the day; air traffic control restrictions substantially regulated the air space due to weather and staffing issues, which resulted in long delays to flights as aircraft waited for air space ‘slots’ to operate, sometimes for several hours. We had no option but to cancel your flight. We do take reasonable measures to avoid delays and cancellations to our flights by having replacement crews and spare aircraft available in our network. However, in the circumstances, these options would not have helped as your flight was cancelled due to air traffic control restrictions."

    The cancellation wasn't due to air traffic strikes. 

    Are they correct in saying there is no compensation ? The next available flight out of Hamburg was 2 days later.

    And what can my daughter now do ?

    They're simply saying that no (fixed tariff) compensation is due where a flight is cancelled for reasons beyond the airline's control (such as ATC restrictions) but separately, and regardless of cause, they're still required to cover the costs of the replacement flight and any associated accommodation and meals while waiting.

    Did she notify EZY that she was not going to take the alternative flight, or did she just no-show for it?

    They offered alternative flight 2 days later or she could go from Munich the next day. She still missed a days work and they are refusing to pay any compensation ….
