    If they refuse compensation and you cannot afford to deal with this yourself hand it over to a No Win No Fee solicitor like Bott & Co. They will take approximately 1/3rd of your compensation but 2/3rd's of something is better than 100% of nothing and it won't cost you anything.
  • Arrived at Sal airport on the 9th May 2016 only to be told all crew were sick and we couldn't fly.. now for customers who had a package booked with Thomson, they were obviously sorted for accommodation and transport etc..however i was self catering and had to pay for a taxi back to the town, find another nights accommodation, pay for all food and expenses and get a taxi back to the airport the next day! I filed the claim form on Thomson's website the day after and heard nothing until i called to chase on Monday.. i then received an email advising i was not entitled to any compensation due to it being an extraordinary circumstance!? Really need some help with this please.. their crew were sick and they should of had back up crew! What can i do??

    Thomson are COMPLETELY wrong. You are entitled to 261/2004 compensation payments in respect of both the delay and lack of duty of care payments.

    Had a call from Thomson to say they will pay for the 2 adults (400 euros each) but the infant wont get a payout which I understand but also my free child place wont get a payout (even though she had a seat on the plane). He said if I can show I paid something for this allocated seat that they will pay out 400 euros for her also ( they are in the mean time sending the cheque for the other 2 passengers). Not sure if I have email proof of paying anything for the free child allocated seat etc. Does all the above sound okay or am I being fobbed off? Lol. TIA

    If you have paid anything for the little 'uns (2?) , including any administration fee, you are due compensation. Do you not have an invoice with breakdown of charges?
    If not you could sumbit a SAR (subject access request) and they will have to provide a copy of all the data etc hey hold on you.
    Or you could call them at general customer services number and ask for a copy of your flights/holiday invoice as you wish to query something and not tell them its related to your compensation claim. They might send you something without the hassle of a SAR.

    I paid a small select your seat fee for the 2 year old and the 11 month old we only paid a supplementary fee of £35.00. He said we wouldnt get anything for the baby which I accepted but I was adamant we would get something for the 2 year old as she had a seat on the flight.

    Someone will need to check the actual reg for the infant. But if you paid anything for the 2 year old, they paid for the seat and are due compensation. AFAIK, these cases have made it to court and been successful for the claimant. Sucks for the airline but there it is. As we all know, these seats/places aren't free, they will just load it somewhere else ie those that don't have kids with them!

    The relevant line from the regulation:- Article 3, para. 3. Quote it at them when you call them back.
    This Regulation shall not apply to passengers travelling free of charge or at a reduced fare not available directly or indirectly to the public. However, it shall apply to passengers having tickets issued under a frequent flyer programme or other commercial programme by an air carrier or tour operator.
    You paid something and it was available to the general public. Serves them right for charging you extra to allow your 2 year old to sit next to you. ;)

    Actually you should get it for the infant too, the regulation makes no mention of actually having a seat, just a valid ticket/boarding pass and having paid something.
    Unless some the veteran forumites disagree?
