    Hi,
    I have checked times and was delayed on a flight back from Cancun to LGW however flight was in 2009, is it worth putting in a claim for a flight so far back?

    In a word, no.

    You only have 6 years to start your legal case in this country.

  • Just wanted to share a success story. We took a family package holiday to Florida in 2010 which started with a 5 hour flight delay at Gatwick. When news initially came out about compensation claims, it seemed to not apply to package holidays, and I seem to recall something about needing to submit boarding passes of which I could only find 3 of 8. Anyway, decided not to claim until recently spotted some package holiday claims had been successful. I used Resolver via the MSE site and submitted a claim for 8 of us on 21 May, received an e-mail from Thomson the following day saying they would respond within 56 days. I wasn't holding out much hope as although I had all our flight details, I was not certain what actually caused the delays - we kept hearing different stories at the airport, and it was nearly 6 years ago! Was therefore thrilled to received a letter from Thomson last week enclosing the full 600 Euro per person refund for all 8 of us :-)

    I contacted Thomson Airways through the Resolver tool on 15th Feb. After 6 emails, still no reply.

    I was delayed by over 6 hours because of a loose bolt found by the plane. I flew in March 2012.

    I have contacted them a dozen times on facebook. Yesterday, after waiting 2 weeks for them to check their system they say they haven't received my flight delay claim! I have the automated emails to prove they were sent! I'm at wits end, they are blocking me from claiming in every way possible.

    I booked it through low cost holidays. I have the email from them with my flight number, dates, passenger names etc. They say the booking isn't in my name!

    I've literally had enough. I'm so annoyed i've instructed a solicitor. Before I give him the final go ahead, is there anything else I can do?

    Read Vauban's guide? Issue an NBA then submit your claims via the courts if they do not respond.
    Are you using an experienced flight delay claims solicitor, such as Botts?

    As this will be a small claims, you won't get any of your legal fees refunded - even a no win no fee lawyers will take a third of your award. For a case like this, straightforward technical defect, it really shouldn't be too difficult to do yourself.

    It will be 5 weeks thursday since I submitted my claim to thomson on their website and is 2 weeks today since I emailed them to follow up. No response to any of them. I cant afford to take further action so will wait out up to the 56 days they advise and see what happens. Thinking I should have gone through Resolver now?! Lol.

    Google Vaubans guide read and send a letter before action template in the guide. Will cost you the price of a stamp, get proof of posting.

    I cant get access to the guide unfortunately. My phone is rubbish. Lol. I did send the NBA but have had no response after the time given but cant afford to take further action it seems. Lol.

    They have advised it will take a further 3-4 weeks at most to thoroughly investigate my claim and for me to get an answer from them.
