Hi, I have been trying to claim for a delayed flight to Costa Rica since jan 2013. Now I have been told after being completely ignored that thomson won't look at my claim as I don't have the booking reference or the seat stubs even though I provided them with the flight number and immigration stamps upon arriving in Costa Rica.
I have just sent another letter stating I have two friends who can provide witness that we went, as they came on the same holiday with us!
Please can anyone advise now what to do, I'm sure like many thomson are being unhelpful so thT people give up.:mad:0 -

5.2 Airlines are likely also to ask you for boarding cards or other evidence that you were on the flight. If you have retained such documentation, then by all means send copies (not originals). If you do not have the boarding cards, then consider what other documentation you may have to demonstrate – on the balance of probability (which is the test applied in the small claims court) – that you were on the flight. If you booked with a travel agent, see if they still retain a record of your booking. Or write to the airline directly, with a “subject access request” asking them to perform a legal search (under the Data Protection Act) on what information they hold on you. This is likely to cost £10. It is unclear for how long airlines retain passenger manifest details, so it is possible that on older claims airlines will no longer hold this information. The legal test however remains the same.0

Hi all,
I went through mcol as I was getting nowhere with thomsons directly, but now I'm rather confused and I don't know what to do next.
I filed a claim against Thomson. They filed a defence.
But then they didn't respond so the court struck out their defence.
I filed a judgement and this has been entered against Thomson.
But what next?
I never actually went to court.. Do I phone Thomson? Do I wait for a check to come through the post? Or am I supposed to do something else?
On a brighter note.. Bott and co settled my other claim with Thomson after only a month or two! Result.
And that was for a claim that cca said I had no claim!0 -

If you have a judgement reference they should agree to apply quite quickly, offer your bank details.0

Well Thomson have paid up. Received a cheque for £1,750 on Monday. Did not have to take them to court. Just kept sending them letters once a month. :beer:0

Yes. They need proof, anyone can take a family member to say you was on the flight.0

Thomson have just paid me up. Received a cheque today for £1,750. We were delayed back in 2010. Did not have to take them to court, just kept sending them a letter once a month without fail.
