    Hi, I claimed for a 9 hour delay on a Tom flight in 2006 back in January 2013 from Doncaster to Pisa on Thomson Fly

    The response I got back at the end of Feb 2013 without prejudice stating that Thomson cannot consider claims for flights that were delayed more than two years ago.

    Is it worth pursuing this today? I have a genuine grievance in terms of the delay.

    Thoughts?

    Any advice appreciated

  • Hi everyone,

    A newbie here, I had a 24hr plus delay with Thomson's flying back from Orlando last August, I went through the correct procedures and wrote to them using templates from this website, we were given accommodation and food but we were treated poorly in my opinion with a lack of professionalism from the Thomson staff. I received an initial letter back from Thomson's denying my claim as the fault was down to an unforeseen technical issue and asked to reply at a later date after an ongoing court case was settled. I did this and they came back with the same unhelpful reply. I then got in contact with the CAA and they took up the case, I received a letter from Thomson thanking me for contacting the CAA and that their original decision not to pay compensation would be upheld. After reciving this letter from Thomson I got in contact with the CAA and they told me that the case was still ongoing. How can this be? Also I have read recently that people have claimed compensation for delayed flights because there was no crew availble to man the aircraft, is this poosible to do. I dont really want to go the final step to small claims court just in case I lose as I wouldn't have the funds to pay the costs.
    Can anybody shed any light?

    I too was playing with the idea of using the CAA rather than forking out money I don't really have for court costs, there were 7 of us so £205, and with the figures involved running the risk of losing, as by my calculation the amount is over £3,500 with the court costs. Your experience has now forced my hand I reckon, so forms are going off tomorrow.

    Knock on effect from a flight from Dom Republic to Manchester, diverted to Azores due to oil pressure. This may or may not be an extraordinary circumstance, but the people in Manchester were 9 hours late going out to the states as Thomson had to source a different plane, and then us in Orlando were left not being able to get back till the next day as the crew were out of hours. Reading this forum it looks pretty clear cut to me, but you still can't help that nagging doubt can you?

    Anyway, hand forced now I reckon.

    I sent my initial letters (by post and email) to:

    I then sent my LBA and used this address on the Claim Form.

    How did you work out your court costs? My initial court fee was £70 (two claimants) and I think if it gets to court there's a further fee (I didn't get that far - Thomsons settled) but not £3,500.

    Using the N1 form with all 7 of us on it, I believe it depends on the amount claimed? The court staff have told me it is £205, so I guess that is right?

    It's your initial court fee plus the hearing fee
  • Ah, I thought you were saying the Court fees were going to be £3,500 ! I only paid the £70 Court fee when we issued.

    Today received a cheque from Thomson for £1370 and last week received £990 for bott and co.
    Both in relation to our family trip to Orlando last year. 3 hour delay there and 4 hours coming home.
    To be perfectly honest, the compensation we recieced is disproportionate to the hardship we had, but it's still a nice victory for me.
    I feel for those that are delayed much longer and get exactly the same amount. There should probably be a sliding scale for compensation in my opinion.

    Well done, do you mean you think the compensation was too high for what was a 7 hour total delay, or too low?
