What about the claimants service address, do you just put the same Crawley address in both? as on the N1 form there is two sections for address of the defendant, I was thinking the registered Crawley address for the first and the Luton address for the second as that's where all the correspondance has come back from when sending letters and LBA etc. ?
Defendant(s) name and address(es) including postcode
Defendant’s name and address for service including postcode0 -
No, I only used the Crawley address. So for the first box headed defendant I put:
Defendant:
THOMSON AIRWAYS LIMITED whose registered office is TUI Travel House, Crawley Business Quarter, Fleming Way, Crawley, West Sussex, RH10 9QL
And in the box at the bottom of page one where it says "Defendant's name and address including postcode" I put "as above".0 -
Hi everyone,
A newbie here, I had a 24hr plus delay with Thomson's flying back from Orlando last August, I went through the correct procedures and wrote to them using templates from this website, we were given accommodation and food but we were treated poorly in my opinion with a lack of professionalism from the Thomson staff. I received an initial letter back from Thomson's denying my claim as the fault was down to an unforeseen technical issue and asked to reply at a later date after an ongoing court case was settled. I did this and they came back with the same unhelpful reply. I then got in contact with the CAA and they took up the case, I received a letter from Thomson thanking me for contacting the CAA and that their original decision not to pay compensation would be upheld. After reciving this letter from Thomson I got in contact with the CAA and they told me that the case was still ongoing. How can this be? Also I have read recently that people have claimed compensation for delayed flights because there was no crew availble to man the aircraft, is this poosible to do. I dont really want to go the final step to small claims court just in case I lose as I wouldn't have the funds to pay the costs.
Can anybody shed any light?
Many thanks

Use a NWNF company if you are worried about costs. if you wish to do it yourself, read Vauban's Guide, but there is initial court costs to pay to file the forms etc.0

Simon - my flight was delayed for 3 separate reasons - Thomsons said the first delay was bird strike (which was to was to a plane a few days before mine so knock on (& extraordinary circumstances according to them )), to date they haven't got back to me about what the 2nd delay was, the third was due to crew out of hours - my experience is they will knock you back all the way so either instruct a NWNF lawyer or send LBA and then when they ignore that, issue a claim - if you search for my posts you will see my journey, but having sent them my draft PoC, which they never acknowledged, they called me to settle a week or so after I issued a claim - with the same PoC !
I obvs don't know the merits of your case but if you are worried about costs, then instruct a NWNF lawyer - Bott & Co seem to do well.0 -

If you win, or they settle, you get the court fees back.0 -
Scorpio, just so that you are clear, flight delay compo is against the *airline*, not any package co/travel agent, so get the notion that First Choice are somehow involved out of your head.0

Just a quick update on my progress. I was delayed on a flight from Manchester to Antalya on the 28-05-15 and used the resolver website to start my complaint on the 17-06-15.
I escalated the complaint two times since then and yesterday I received a cheque through the post equating to 800 euros (two adults), worked out about £560.
All very easy and I was shocked at how easy, I thought I would be battling for a year or so but no, paid out within two months.
Thumbs up!!0 -
Some advice plse , i went down the route of trying to claim compensation myself and was refused, so instructed a NWNF back in April, still not resolved and to be quite honest not really happy with there response when i ask for info. People on this flight have been paid compo, so should i bin the NWNF and try going through resolver?0
