  • We were delayed 8hrs from Zante to Cardiff 04/09/2014 flight No. TCX 7325 we made a claim to Thomas Cook finally in January 2015 they agreed to pay out £960 for 3 passengers and then sent an E-Voucher. I have e-mailed 3 times requesting cash/cheque but have had no reply. Any suggestions how to get a responce.

    We were delayed for 8 hours in August 2012. This is about the 4th time Thomas Cook have denied our claim.

    Any advice gratefully accepted Please see their latest reply.

    'Thanks so much for being patient whilst we investigated your recent enquiry about your flight and previous claim with Thomas Cook Airlines. I have now completed the review of your claim for flight TCX 1516.

    As you are aware, the previous investigation showed that the cause of the delay was as a result of a technical fault in which was not inherent in the normal course of activity.

    A recent Supreme Court decision in the case of Huzar vs. Jet2.com, has resulted in a change to how EC Regulation 261/2004 is interpreted. This is the Regulation that provides for compensation payments for flight delays so we wanted to check if the outcome from your previous claim has changed as a result of this.

    Following the review, under EC Regulation 261/2004 your case has been re-assessed and I can see from the aviation report that your delay was caused by a manufacturing defect of a part we had replaced on the aircraft. Based on this information under the revised EC Regulation 261/2004, technical faults due to manufacturing defects were not affected by the court ruling and remain classified as extraordinary circumstances, therefore I am unable to offer you compensation for your claim.'

    Hogwash, don't fall for it, read Vaubans guide and issue an NBA.

    It's the latest excuse by the airlines, Jet2, Monarch and Thomas Cook they're all at it!

    That's the number that I am planning to use on Monday to give them a polite nudge (so far I've been using relations.customer@thomascook.com which was the address they have been replying from following my on-line claim back in November 2014)

    @Star9272 --- Just out of interest - what was the outcome when you phoned ?

    There was no problem. Make sure you dot your i's & cross your T's when giving bank details. They don't come back to you if you've given wrong information - you have to do the chasing - you can start thinking what to spend it on tee hee :j

    Surely the airlines are playing with fire in brining forward this bogus claim that the parts they have replaced had manufacturing defects. wouldn't they have to notify the appropriate authority of the defect also the manufacturer. Any judge worth their salt would require reports on the defective parts after all safety is paramount. Once they are challenged and have to produce this evidence in court they will back off. Don't be put off I believe they are making a fatal mistake and they are just clutching at straws as they know they are fighting a losing battle.
